    Good Morning,

    I don't know if this is too far gone to do anything but hoping someone may be able to help.....

    Bought a car with an explained to us as 'Gold everything covered warranty', which turned out to only cover £1000, got home around 5pm on the day of purchase – Went out to use it in the evening and wouldn't start

    Crank Shaft Sensor had failed


    2 days later – Battery light came on

    Alternator belt problem


    4 Days later the Engine management light came on due to misfire and dealer replaced spark plugs.

    Yes, in hindsight, at this point should have given the car back but it was our dream (nightmare) car.


    Our local mechanic put the car on his computer and gave us a print out of the many issues which we took to the dealer and they dismissed it by clearing down the computer and saying “Keep an eye on it”


    One week later car still misfiring went back to dealer and they supposedly changed the coil packs.


    Radiator fan stopped working


    Secondary air injector bank failed


    Air Bag light came on and was due to go back to dealer to be repaired when the engine went pop. One of the cylinders was completely gone and not repairable. That was in March 4 months and 19 days after we got the vehicle. The dealer said we couldn't prove that the engine already had the fault and they couldn't prove it was something we had done. We came to an arrangement with dealer that we would go 50/50 on on a 'recon' engine. All was agreed and an engine had been 'sourced' from a supplier. The engine eventually arrived on 4th May, 2 months after they had received the vehicle. It was broken when it arrived and had to go back. Parts from the old engine were used on the 'new' engine. We eventually got the car back at the end of May. Dealer told us they had put a recon engine in but turns out it was just second hand.

    Day after we got car back the battery light came on and the alternator pulley had come lose so the belt came off.

    The engine management light kept coming on and was diagnosed as misfire STILL. Dealer had a look at it and I believe they replaced a coil pack.

    After losing faith in the dealer we took the car to two different garages and they both said the head gasket was on it's way out and would cost a fortune to fix.

    We contacted the dealer as we felt the 'new' engine wasn't up to standard. They said there was nothing they could do as the people they bought it from only offer a 3 month warranty.

    We contacted the finance company and they can't help.

    We now have another 11 months of finance left to pay for basically a chunk of metal sitting outside my house.

    Is there ANYTHING I can do.

      Hello,

      What was the date you purchased the car?
      What type of finance did you take out?
      Why did the finance company say they can't help you?

      Are you able to set out a timeline of events as there seems to be a number of issues that have gone wrong and it would just help us than having to scan through the text, something like the below would help.

      Jan '17: Purchased car, issues started occurring
      Feb '17: Garage refused to repair and said monitor the situation
      etc.

        Thank you for replying. Series of events as follows.....

        24 Oct 2016 - Purchased car
        Oct 2016 - Crank Shaft Sensor Failed
        Oct 2016 - Alternator Belt came off
        Nov 2016 - EML on due to misfire - Spark Plugs replaced
        Nov 2016 - Coil Pack Replaced (Still misfiring)
        Nov/Dec 2016 - Radiator Fan stopped working
        Nov/Dec 2016 - Secondary Air Injector Bank Failed - Cleared error code told to keep eye on it.
        Dec- Mar Kept trying to get the 'misfire' fixed - Dealer said they had replaced coil packs on several occasions
        Mar 2017 - Cylinder 2 blew up
        Mar2017 - Agreed to pay £2000towards repair and labour (have this in email) - Which actually turned out to be a second hand engine although on a number of occasions they have told me and our mechanic it was a recon
        May 2017 - Engine arrived broken on nearside (have pictures) sent back for repair
        May 2017 - Engine arrived again - Parts from old engine used on new engine
        Apr 2017 - Alternator Pulley failed
        May - Oct 2017 - Still misfiring - Dealer keeps saying sorted
        Nov 2017 Took car to two independent garages and both said nearside head gasket 'on way out'
        Nov 2017 - Dealer said they couldn't help as the people they bought the engine from only gave them a 3 month warranty.
        Nov 2017 - Finance company said they couldn't help because of the age of the car (2004) and that the head gasket going is a possibility as it has done 95,000 miles

        Finance was a 2 year finance with MotoNovo through the dealer.

        I'm sure I've just gotta bite the bullet but if there is anything I can do I'd be very grateful or your advice.

          If the dealer claims that they inserted a RECONDITIONED engine in the vehicle it should last well beyond 100,000 miles!
          (I reconditioned my old MGB engine myself130,000 miles ago and it still shows oil pressure when warm of 55psi ... and that is old technology. Modern engineering is much improved on that.
          You paid £2000 towards this engine? Any paperwork showing what you were getting for your money?

          The finance company appear to have had nothing to do with that, so IMO you should be looking to the dealer.
          Yes, it is over 6 months since it was installed, but apparently been in and out the garage a lot so possibly within that six month window allowed by CRA 2015
          Under the 1979 Sale of Goods Act you have 6 years in which to lodge a claim for goods which are not of "satisfactory quality" (which includes durability.).

            Would the Consumer Rights Act 2015 not be more applicable as that stops the clock while it is in being "repaired"?

              If the times fit I'd agree that CRA is the way to go, but the time schedules here seem tight so I mentioned SOGA as a back up, just in case
