    Sorry unsure how to use leagle beagles. Help needed please. I vt'd 6 year old car in september well over half payments as per contract. Manheim inspected for damages. I disagreed with pricing and damage as i believe its fair wear and tear. Shoosmiths wrote to me so i sent robs letter re:damages and i will defend in court (included i had paid x amount over half payments). Shoosmiths have now rang to offer a "deal" which i declined as they say over payment doesnt count and i owe the total they were originally after. As i declined they said because i have refused to pay they will now close their case and send it back to GMAC?? Im confused. Any help would be appreciated. Thanks in advance

    As far as I am aware, whenever GMAC seek to recover any charges or damages due to the vehicle, they automatically send it out to Shoosmiths who will try as hard as they can to threaten, intimidate or coerce you into paying up. If that fails then they send it back to GMAC who don't seem to do much more than that.

    You should however keep an eye on your credit file as some lenders have been known to record defaults or other adverse information on there. They shouldn;t do this and it can be a breach of the Data Protection Act 1998 but some lenders know that consumers won't take them to court over it or are too afraid. You need to take this into account when you dispute these charges.

        Out of curiosity, what was the 'deal' that they offered? Was it substantially lower than what they were seeking to obtain or minimal?

          She didnt make an offer just kept asking me if i refused to pay which i just said i hadnt used the word refused??

            I see, well as above just keep an eye on things but GMAC as far as I know are all talk no action.

              Hi R0b

              Just a quick update. I have recieved my annual statement that has a closing balance of the charges, however, it does not state anywhere on the letter that these are the damage charges just states closing balance.

              Am i right to ignore this, as i feel it has been disputed and is just a summary that they are trying to intimidate me with?? Can they pass this on to baliffs if i have written to shoosmiths to take me.to court?
