    [IMG]https://legalbeagles.info/forums/image/gif;******,R0lGODlhAQABAPABAP///wAAACH5BAEKAAAALAAAAAABAAEAAAICRAEAOw==[/IMG]​ We recently received a PCN from Euro Car Parks, and appealed to Euro Car Parks on the basis that we paid more than was required for the time spent in the car park, albeit in 2 separate payments.

    If you treat the second session (after the initial parking period had expired) as a separate session, the second payment made would not cover that second session (it’s only if you combine the two sessions, and the combine the two payments that one can say the total payment, covered the total time in the car park). Both payments were made before the car exited the car park. Hopefully that makes sense.

    We appealed with the below and have got what appears to be a standard rejection letter not addressing the main point of our appeal. Not sure whether to appeal to popla or cut our losses. What do you think our chances are? Any advice would be greatly appreciated.

    The appeal we sent to Euro car parks is below and the PCN is attached.

    APPEAL TO EURO CAR PARKS

    Parking payments totalling £7.60 were made before the vehicle exited the site. The published tariff for this location (682928) shows a four-hour stay costs £5.90, meaning the amount paid exceeded the applicable tariff for the duration of stay. The allegation that the parking period was unpaid or improperly paid is therefore disputed.

    The updated Private Parking Sector Single Code of Practice introduced provisions intended to prevent Parking Charge Notices being issued where motorists pay in full for the duration of their stay before leaving an ANPR-monitored car park. In this case, payment exceeding the applicable tariff was made prior to exit.

    It is also relevant that the driver has diagnosed ADHD, affecting executive functioning and time awareness. Reasonable discretion and consideration are respectfully requested.
