  • Question on POLA and parking on private land.

When you park in one of those pay and display car parks, with whom is the contract made, the registered keeper, the driver, or the person that pays the machine?

Of course these could be three sepperate people. If so who should the land owner of his agent pursue, in particular if using a credit card to pay.

Normally it is assumed that the contract is made with the driver. If the driver did not pay then an interesting situation. The registered keeper doesn't come into it, unless they were the driver

Could you please flesh this out a bit more. Normally assumed by who, what limits to this are there? How might you evidence this if indeed evidence is needed and does that invalidate correspondence sent to the driver?
