  • Smart Parking PCN - IBIS Hotel Reading - Help!-won

    Good Afternoon Everyone,

I wanted to ask for your help as I would like to appeal to POPLA since I sent Smart Parking an appeal and they replied by letter stating that they would uphold the parking charge.

This was my appeal to Smart Parking and will also help you understand what happened:

    Good Morning,

I would like to appeal from my PCN since on that day I did went to the IBIS in Oxford Street on the 17.06.2016 as your cameras shown, but I did went there to help my Mother and Father in Law to check-in into the Ibis Hotel as they don't speak English, as you will be able to check on my supporting documents in attach with the check-in details and the time of payment for the Hotel itself recorded as 15h04. If you are able to check the pictures/video of the time you will see that just after that time we went back to my car to unload their suitcases. At reception we asked if there would be any issue for me to have my car parked in the car park for a few minutes as we where doing the check-in to which they confirmed I wouldn't. My Father in Law paid £15 to have his rent-a-car parked in the Hotel car Park as you will also be able to confirm by the payment slip. For this reasons I kindly ask you to waive my Parking charge as I did really went to the IBIS and was mislead in regards to the possibility of a paking fine being aplied for the 15 min parked in the Hotel car park.

    Kind Regards,

    XXXXXXXX

To this appeal I attached as backup the payment slips and invoices from the Hotel confirming the times and place.

I got their letter today stating that they would still uphold the parking charge as I don't have grounds to appeal and if I wanted to appeal to use POPLA to do so but running the risk of going beyond the date they gave me to pay a reduced parking charge of £60 instead of £100.

Do you think I have any chance of winning this using POPLA?

Thank you so much for your Help!!

Have you contacted IBIS and asked them to cancel the charge as they agreed that the stay was fine.

          Definitely contact the manager.

Also sanitise the PCN and post it up.

Take that picture down and modify it so that the PCN number is not showing (including the bar code), the registration details of the car and your name and address.

A quick glance at the notice makes me think that it does not comply with the requirements of POFA and therefore they cannot claim from the keeper, only the drive, who they do not know..

Check how long you have for a popla appeal. If the manager hasn't cancelled with 9/10 days left then give me a shout.

                      Hi!

I got an email from the General Manager of IBIS letting me know that he had forwarded my email to them requesting the ticket to be cancelled and that as soon as he had a confirmation that he would let me know. I checked as well the POPLA days left and I still have 21 days.

As soon as I have the confirmation from the GM I will let you know.

                      Thank you!
