  • **CANCELLED** MET Parking services notice how best to proceed?

    Hi Everyone,

If anyone is able to help I would be very grateful.

After a recent trip abroad I returned home to discover one of these parking notices in my mail. According to the notice I overstayed my welcome in a McDonalds/Krispy Kreme Car Park near Enfield by a whole 19 minutes for which MET Parking services believe I owe them £100 reduced to £50 if paid within a certain time. At first I thought fair enough and thought the notice to be the same as one that is issued by a Council or Local Authority but after digging a little deeper I realised that this wasn't the case. As I don't recall seeing any signage there then I don't believe that I should have to pay such an exorbitant amount especially as I purchased items from both restaurants during my stay. Having had a look around the web and this forum it seems that these companies are pretty much carrying on from what cowboy clampers used to do. I have attached a copy of the notice with name and details removed and any help would be greatly appreciated.

I would say appeal and then when rejected go to popla based on the fact i believe the notice to keeper doesn't comply with PoFA 2012 schedule 4 para 9. This does risk the charge being £100 rather than £60 but also potentially zero.

    Dear Sirs,

I, as registered keeper, wish to invoke your appeals process. The driver did not see any signs . I note your notice to keeper is fundamentally flawed when compared to PoFA 2012 schedule 4 para 9 in several aspects .

Should you reject my appeal please supply a popla code.

    Yours etc

If popla is need let me know.

Thanks for your swift reply M1,

I have been doing a bit of searching this morning and have seen by using google street view that there is a sign on the entrance of the car park which I did not see on arrival. Stating a maximum stay of 90 minutes Would this affect my appeal? I am guessing from what I have read on this and other forums that they would just reject any appeal and ask me to go to the popla route anyway.

      Kind regards,

      CitizenG

Not really. Yes they will reject.

One of the things you will be raising with POPLA is inadequate signage. You didn't see the sign because it was dark and there was not a light on the sign.

            Again thanks,

I will proceed as you have stated with a first appeal and let you know the result. Just for some further information here is a screen grab of the entrance as seen on google street view.

I would say that it would be extremely difficult, if not impossible, to read that sign if you were turning into the site from the A10, especially if it was dark. The sign would have been on the left of the car on the turn while you were concentrating on safely completing the turn into the site and looking ahead.

I would like to pass my thanks onto everyone for their help regarding this especially mystery1 for their draft letter.

I received a letter from MET parking services today stating that on this occasion my representation has been accepted and that they are cancelling the charge.
