  • **WON** ParkingEye

I received a Parking Eye charge for parking in a car park for 10 mins at midnight. I stayed in the vehicle and moved it shortly afterwards. I was simply making a telephone call!

They now want £60 though I'm completely lost on how/where to appeal and if I have any grounds.

Can someone help. I have attached the ticket here.

    Many thanks

    When is your deadline ?

I would try "see appeal" for any questions about the driver etc.

Until some adjudications are seen it's difficult to advise anything different to the old style appeals. Hopefully they'll still win but who knows. In the absence of any new decisions there is little else you can do.

Some examples of where we had to proceed on the new system as the deadline was nearly up

    Re: ParkingEye

What was the reason for the ticket ?

    Is parking allowed there ?

      Re: ParkingEye

The parking is at the Parking lot in the Raddison Blu Hotel at Stanstead Airport. The ticket says it was private land and by not purching the appropriate parking time or remaining in the car park longer than permitted.

I drove into the car park, there being no barriers, parking into a bay, of which there were plenty free and stayed in the car, making my mobile phone call. I then drove out 10 mins later.

Hope that helps? I'm attaching the rest of the letter here.

        What i would do is

        Dear Sirs,

I, as registered keeper, wish to invoke your appeals process. The driver did not see any signs. I note your notice to keeper is fundamentally flawed when compared to PoFA 2012 schedule 4 para 9. Further i note that you have not applied the grace period from your trade code of practice.

Should you reject my appeal please supply a popla code.

        Yours etc

        M1

          Thanks M1.

Letter in post right away. Will send it recorded.

Will contact again once I get a reply.

Many thanks for this, especially after the Beavis decision it seems we are completely being screwed.

                Hi M1,

I've just had post from Parking eye notifying me that my appeal was unsuccessful. They've given me a POPLA code.

Can you please advise me on how to proceed.

                Many thanks.

Remind me in 3 weeks as it'll give us time to peruse the results from the result wave of appeals. (you get 28 days to appeal)

                    Hi M1,

You asked me to remind you in 3 weeks. How do you suggest I move this forward?

                    Many thanks.

Message from M1 saying "to try".

Presumably to do with the above.
