Smart Parking Fine at Asda Car Park in Brighton Marina - Won

I have just received a parking notice from a company called Smart Parking for parking in an Asda car park in Brighton Marina. They provide 3 hours of free car parking but I never actually noticed the signs and over stayed this by approx. 40mins. I didn't actually shop in Asda at the time but we buy from Asda all the time. I phoned the store and they said that if I had a receipt they would cancel it but if I didn't regardless of whether I was a customer I would have to pay the fine. They weren't bothered when I said I would shop somewhere else. I have previously received a parking notice from Park Direct and sent them a letter similar to the attached and appealed to Popla and they cancelled the fine. I was thinking of sending them the letter as attached but would appreciate some help on this as they word their letters slightly differently to Park Direct.

I, as registered keeper, wish to invoke your appeals process. The driver was a genuine customer and saw no signs. I note your notice to keeper is fundamentally flawed when compared to PoFA 2012 schedule 4 para 9 in several aspects .


Should you reject my appeal please supply a popla code.

So should I just email them what you suggest rather than sending the letter I drafted?
I wasn't actually shopping there at the time but does that not matter? Just they may come back and say send proof of shopping receipt but as we have asked for a Popla code does that not matter?

It probably makes little difference. After Beavis today all you appear to have is keeper liability. Under no circumstances admit who the driver was or you'll lose.
