  • MET parking notice - won

    Hi all
I was issued with parking charge notice for £100 - for 'parking outside markings of a parking bay' at a council run swimming pool. There is no charge for using the car park but there are visible signs from MET parking displaying their parking rules, one if which does state that cars must be placed within a marked bay.
My car was outside of the line but another car was able to use the adjacent space so I did not block a second space. Is it worth appealing ? I feel that a £60 fine ( if I pay up within the next 5 days) is excessive for using a free car park. Do you think I have a case? Many thanks

    Re: MET parking notice

I assume this was a ticket on the windscreen ?

In that case wait until the notice to keeper arrives which should be between day 28 and 56. MET notices that i've seen are all woefully inadequate in compliance with the protection of freedoms act 2012 schedule 4 and thus the keeper liability they need to chase the keeper is hopeless in law. As the don't know who the driver is it means they're screwed.

        Re: MET parking notice

        Dear M1
I have now received a letter from MET parking requesting £100 to be paid within the next 14 days. It includes a photo which shows that although I was over the white lines a car was still able to park next to me hence I did not prevent another car from parking. I have attached the letter and a photo of MET sign as well sign original notice which was attached to my window screen. I would gratefully appreciate your advice on what steps I need to
        take next. Thank you

How long does the registered keeper have to appeal ?

            Re: MET parking notice

The letter states that appeals and complaints must be made within 28 days from date of initial correspondence.

              Re: MET parking notice

Perfect. Wait 3 weeks and then appeal so they have liitle/no time to issue a compliant notice to keeper.

              Dear Sirs,

I, as registered keeper, wish to invoke your appeals procedure. The driver did not park in an obstructive manner and any distance over the line would be de minimis (trivial in the eyes of a court). Your notice to keeper is fundamentally flawed in that it does not comply with PoFA 2012 schedule 4 paragraph 8 and therefore you should contact the driver, whom i am under o statutory duty to name.

Should you reject my appeal then please supply a popla code.

              Yours etc

              M1
