  • Deal claim struck out - Costs awarded to defendant

    Having received one of the many DEAL claims last November I firstly panicked a bit and then turned to the net for more information. I found this site and also Pepipoo and Parking Prankster, by following other cases here and using the defence from here my case was yesterday struck out due to DEALs lack of a response to the courts order to reply to my defence.
    I have submitted a claim for costs and will wait and see. However I wanted to say a big thank you to the people here who freely give such good advice and support to those of us who are facing the courts for the first time.

    Thanks for sharing that and well done.

    The court system can be a scary thing if you have never had to experience it before. With the help of this and other good forums such as Pepipoo & Parking Prankster it shows that with help & guidance you can stand up to the bullies. As always my own thanks to members such as Mystery1 who give their time and knowledge freely to help others.

      Maybe if more people who have had cases struck out or discontinued pursued for costs then it may make some of these PPCs sit up and take note that it is going to hit them in the pocket hard for their ill thought out claims. What I would really like is to see someone get a costs award for more than £600 & then send a HCEO in to collect.

        Well yesterday I received a letter from the court awarding me costs against DEAL, I quote:
        IT IS ORDERED THAT

        The Claimant do pay the Defendants reasonable costs as a Litigant in Person, such costs to be assessed in default of agreement.

        I made what I considered to be a reasonable claim for £75.32 and the judge seemed to agree. Whether or not I shall see any of it remains to be seen!
        Once again thanks to all the posters on here for your advice and to anyone defending acclaim from DEAL, stick at it because sooner or later they DO give in.

            Today I received a cheque from DEAL for the costs ordered by the court.:tinysmile_grin_t:

            Interesting to see that the covering letter had no address on the header.

            That finally ends the DEAL saga, again thanks to the terrific help I got from Legal Beagles, I honestly could not have done this without you.

                I have received my cheque today from DEAL/CEl for £324 costs, hope it doesn't bounce ! Hopefully a lot more people will now start to claim costs against them, which might put a stop to all this nonsense.
