        Thanks, I was anxious that I needed to reply by 4.30pm today so I sent a reply but finished it by saying I may update it when I'd spoken to legal persons supporting me....hope this wasn't wrong?

          Well it helps as it stops default judgement. I might as well do this tomorrow to make sure it's as thorough as i can be.

                      Email it to the court.

                      In the subject line put Parking eye v you - defence case xxxxxxxx (the claim number)

                      If in doubt about the email address or format call the court.

                        Morning M1, I've received a letter from parking eye which is a "notice to proceed". There are a number of pages attached. I would normally e mail them to Kati as I'm not sure how to attach them to this e mail. Shall I do this?

                                There is no need to do anything at the moment until the directions questionnaire arrives.

                                It should be noted though that in point 1 of the reply to defence that ParkingEye are wrong in their contention that you should have contacted the court about an extension.

                                The rules are http://www.justice.gov.uk/courts/pro...es/part15#15.5

                                Agreement extending the period for filing a defence
                                15.5
                                (1) The defendant and the claimant may agree that the period for filing a defence specified in rule 15.4 shall be extended by up to 28 days.
                                (2) Where the defendant and the claimant agree to extend the period for filing a defence, the defendant must notify the court in writing.



                                Fairly clear i would say. Contact the opponent then tell the court you've agreed.


                                So what does this mean ? Not a lot really. They are not obliged to agree and as far as the case goes there is nothing you can do about it. However when it comes to costs, win or lose, it does go some way to showing unreasonable behaviour on their part and it should be brought to the courts attention when costs are decided. (higher cost for you if you win and lower costs(or none) for parkingeye if they win).

                                (g) such further costs as the court may assess by the summary procedure and order to be paid by a party who has behaved unreasonably





                                As for point 2, how accurate is it ? Make notes.
