  • Re: Civil Enforcement Ltd CCJ County Court - won

    Hi
This is my first time posting and I'm really grateful for any responses.
I obtained my credit file from Equifax on Friday and to my dismay found I have a CCJ for £165 from Sept 2014 at an address I haven't lived at for 4 years
Upon further investigation using Trust online and contacting the Money Claims Court I've found out the Claimant is Civil Enforcement (CE) for Breach of Contract and a reference number starting PCN was given.
I have tried to contact CE by phone - I get a recorded message requesting payment and no option to speak to anyone, and by email (no response as yet) I am at a complete loss as to what this claim is for or what contract I have breached?
What chances do I have, asking for the judgement to be set aside?
I have been advised it will cost me £155 in court fees to to request the CCJ to be put aside?
The DVLA were informed of my new address becuase I requested a new driving license.
My fear is I have spent the last 5 years saving hard for a deposit for a house, and will have no chance of securing a mortage with a CCJ on file. I'm 40years old this year, and feel it's my last chance to secure my own home.

You will need to do some work. How and why they used the old address is a good start. Look out your V% and see what the address is on it and the docref date. Find out from the court when proceedings were issued and if possible get a copy of the claim form.

You must act as quickly as possible to set aside.

        M1 thanks for your response.

The link and associated detail on how to set aside the CCJ is very useful. Was looking everywhere on the web for something similar.

I will act immediately on your advice.

Please would you explain what a V% is?

        Thanks again

Re: Civil Enforcement Ltd CCJ County Court

Some info that might help in dealing with claims from CEL/DEAL in respect of Co-op car parks:-
            Useful contacts: -
            1. CEO is Richard Pennycook, email is pennyri@co-operative.coop; also try
            2. Nigel Radcliffe, Head of Customer and Store Contact Centre, email is nigel.radcliffe@co-operative.coop, phones 07779598696, 0800 0686727 ,
            3. Chris Jones (Legal Department), email is chris.jones@co-operative.coop
            4. CEO of CEL is Gary Wain, personal email address:gary@creativecarpark.co.uk, useful if you want to confirm any contact or other message.

It is also worth noting, CEL might be in the habit of installing CCTV ANPR cameras WITHOUT the required planning approval (like they did at Whitby's Co-op - just a concrete example of a non-compliant firm, AND their PCNs carry the instruction to send all appeals/representations to their Liverpool "office" address when their 2011 AOS Code of Practice required they give the option of doing so by email and their website FAQs clearly stated they do not accept appeals by email; next up, at my insistence DVLA insisted (July 2013) that they change their FAQs, which they did, and removed their email address! They later re-established an email address as "appeals@..etc". Possibly someone else complained?

They were eventually kicked out of Whitby's Co-op in September 2013, and subsequently from all of Co-ops stores.

More recently they received an invitation to Aberdeen Sheriff Court and have to return along that long and winding road, from which there is no return (hopefully) to see the Procurator Fiscal. More news will come soon from Parking Prankster!

I hope this is of some help to some.

Re: Civil Enforcement Ltd CCJ County Court

              Hi M1,
I've completed the N244 form, the Draft Order and Witness Statement.
Would you be able to look over the content for me please and let me know if it's in order?
Also where and to whom do I send the N244, other documents and evidence?
If a CCJ is set aside - does it still show on my credit file, or is it removed completely?
I understand that having the CCJ set aside doesn't stop CE starting a new claim... if they do hopefully I will have the opportunity to respond accordingly.
              Thanks for your help.
