      So what do i do from here, how do i write up a defence, who do i send it too, whats the process? Really in the dark here??

        I'll sort something that you can either copy or edit to suit.

        You send it to the court. Then PE either send you a reply to defence or the court sends an allocation questionnaire.

          Hi M1 its getting close to to the end of the 30 days i have to file my defence, can you help me with it? i have no clue where to start?

            Just in from work. You are #2 on the every growing to do list but should be done tomorrow as i'm off. Prefer not to do it when knackered where possible.

                  Just a quick few questions:

                  is this supposed to say 'i have' not 'save as'...

                  2. Save as specifically admitted in this defence the Defendant denies each and every allegation set out in the Particulars of Claim, or implied in Pre action correspondence.

                  Should i print the document sign it then post it or can i just send as an attachment online?

                    'Save as' is an old fashioned legal way of saying except for, so in plain English it would read except as specifically admitted in this defence i.e. unless you have specifically admitted something in your defence, the allegations put by the Claimant are denied.

                    If this is your defence then you could file it online on the MCOL website if it falls within the wordcount

                      I was thinking of putting somewhere in the defence that the person who was driving the vehicle was disabled and there is no clear signage for disabled patrons therefore the terms and conditions were not accepted but i suppose this covers it in what you have written without having to go into the details of who was driving? Would you agree that what you have written sort of backs this up if i ever have to go into detail of the event?

                            Absolutely.

                            At the end of 6 add

                            " The driver was disabled and the signage was not clear for someone who is registered disabled. Signage to create a contract must be clear as per Parking eye v Beavis" or something along those lines.

                                Court. You can phone and get an email address for the court and double check the formats allowed what goes in the subject field of the email etc :okay:
