Yes you will, but if you win then you can claim back up to £95.

I was thinking about the signs that exist. Some badly signed car parks do have areas which are not signed. It is unclear from your photos whether there are signs at the entrance or not.

I am pretty sure that there are no signs at the entrance, to be honest a friend took those pics for me so i will get better pics when i go including the terms and conditions and will look at all the signs at the car park and also take pictures of the entrance at a distance.

I have never represented myself in court, is there anything i should be particularly aware of? or do i just turn up and tell them why i disagree? sounds quite nerve racking :tinysmile_hmm_t2:

Almost everyone shits themselves. If you have a case and set it up well then all that remains is to present it well. The signs are pretty significant though as without them having faults, such as poorly worded or having areas not covered by them, you'll have a weakish case.

Is there anything or anyone i can write to now, ive heard of cases being cancelled before court? do i have to go to the courts they use? or will it be one local to me?

If you know who the landowner/occupier is you could try them. Doesn't look to be tied to a retailer though.

Hi

ive just been back to the car park and there is a sign at the front entrance to the right. However not one parking sign gives a waiting time or has a minimum time limit. So to me that means as soon as you drive on the land you a pic of your reg entering the car park by the ANPR and then another one leaving! Then i am guessing they send fines out to those who havnt entered their reg in the pay machine? I will upload pics later as i am on my mobile. Scandalous some of these companies!! Hundred pound! Its only £12 for 24hour parking on the same site ��

hi guys i am feeling like i am running out of road here, not sure what my defence could be now?

i feel robbed because the driver stopped in the car with the engine running, used the phone then left.

Now the supreme court ruling was after this but did not really change the court of appeal ruling much. The argument, still stands, but is not guaranteed. Having said that if it's not costing you money to try what have you got to lose ?

We need to submit a proper defence within 33 days from the date on the claim form. It'll be ages before a court date and it'll be your local court.

can you help me submit a proper defence? i suppose this is what you are doing now but i mean like how to put it together etc, i am clueless in this

i feel like i should go down the route of the contract was not agreed by me and the pre estimated loss of earnings is unjust especially given the fact that i think it is only about £12 for 24 hours parking never mind 20 mins.

I need to check if there is signage there for disabled parking but if its not i may have another argument

If their is no clear signage for disabled patrons and the driver is registered disabled, then the driver proceeded to look for a disabled parking sign, when they did not find the disabled parking sign and they may have rang a friend to come and read the terms and conditions stated in the car park, once this friend relayed the terms and conditions the driver did not agree to the terms and therefore prcceeded to leave the car park. This may have been the reason that the driver was parked in the car park for 23 minutes and according to BPA code of practice there must be clear signage for disabled patrons. From the signage that i have seen so far only has signage which is about 10 feet up on a post (some pics in this thread) would this be a good argument in court?
