    Good afternoon

    Hope someone can help.

    I recieved a letter on the 15/07/2015 from ParkingEye with a picture of my vehicle entering a private car park and 23 minutes later a picture of my vehicle leaving the car park. They are charging me £100 for not paying for a ticket. The driver of the vehicle never left the car during this time as he making an important phone call.

    They offered a discount of £40 if i paid within 28 days. I ignored all letters from them and today i have received a letter from County Court Business Centre with the claim/charge now increased to £175.00 because of added legal costs.

    The letter has given me 14 days to respond.

    An admission and full payment - which i strongly do not want to do.

    Admit part of the amount claimed

    Dispute the claim and or counter claim against the claimant

    Request for 28 days rather than 14 to prepare a defence or wish to contest the courts juristiction

    Can anyone help me with this please and advise as i wish to fight it ifyou guys think i have a good chance

      Post up the claim form and PCN and signs (if possible). Sanitise personal info.

        i am in the middle of Acknowledgement of Service

        it is asking me if i intend to
        • defend all of this claim
        • defend part of this claim

        and if i am choosing to contest jurisdiction?

        can you advise?

                the driver wasnt actually staying at the hotel, literally just took the nearest entrance to safely park up and use the phone

                i can get signs, will try get them tomorrow and post them up too. i am pretty sure the free waiting time is 15 mins but thats just a generalised guess, the driver genuinely never noticed any parking signs when parking up as he knew he was just using his mobile and therefore wouldnt be too long.

                  Worth a shot though, the worst that happens is they say no. They could have been having coffe/lunch etc or picking up Uncle/Aunt etc

                    yeah good point, will give it a shot tomorrow. so the hotel will have powers to interfere now? i take it ParkingEye have a contract with the hotel and the hotel will not want to upset their own customers. will give it a shot and let you know how i get on

                      I got these pics today, there is no sign as you enter the car park (pics below) there is however a few signs dotted around the car park as shown below

                      still not called the manager but will do so as soon as i can

                      what are your thoughts?

                            Not according to the BPA code of practice:

                            B 18.2
                            ''Entrance signs play an important part in establishing a parking contract and deterring trespassers. Therefore, as well as the signs you must have telling drivers about the terms and conditions for parking, you must also have a standard form of entrance sign at the entrance to the parking area. Entrance signs must tell drivers that the car park is managed and that there are terms and conditions they must be aware of. Entrance signs must follow some minimum general principles and be in a standard format. The size of the sign must take into account the expected speed of vehicles approaching the car park, and it is recommended that you follow Department for Transport guidance on this. See Appendix B for an example of an entrance sign and more information about their use.''

                            although it does follow on to say...

                            Also am I going to have to defend myself in court, I don't mind doing this but will have to take unpaid time off work?

                              Yes you will, but if you win then you can claim back up to £95.

                              I was thinking about the signs that exist. Some badly signed car parks do have areas which are not signed. It is unclear from your photos whether there are signs at the entrance or not.
