Re: UKPC Residential Parking and County Court Claim
Dear halfwit,
Thank you for your letter of xxxx the contents of which are noted.
Sadly it beggars belief that you you think your particulars of claim meet the standards required by CPR 16 and PD 16.
"a concise statement of the facts on which the claimant relies"
"Where a claim is based upon an agreement by conduct, the particulars of claim must specify the conduct relied on and state by whom, when and where the acts constituting the conduct were done."
Somehow you seem to believe that stating the driver has identified themselves but if they haven't we can use PoFA 2012 meets these 2 rules. No right thinking person would. To that end , i ask, are you chasing me as the driver or the registered keeper ?
I also must ask which term has been breached ? What was the offer made by the signs which made a contract ? Where is the copy of the sign which created a contract which the rules state must be sent with a separate particulars of claim ?
Please reply within 4 days.
Yours etc
When is your defence due date ?

Edit to suit, particularly whether they complied with pre action protocol. I have no clue if they did. If unsure just delete the whole paragraph.
