He says space in front of the cash till for all of 3 minutes to buy sugar for hus diabetic episode. There was no screen pcn we were just sent a photo of the car and a photo of the sign. That was last year I have no clue where it would be.

No because we had no idea about this! I will try and get onto them tomorrow. But it does say they're privately owned and that was not a photo of the sign we were sent.

I had an email yesterday saying Gladstones tried to call me to discuss the case and I should call them back if I still need to discuss it. Well by the time I can access my personal email it's too late to call them and it's left me with hardly any time since I need to submit a defence. What should I do? Considering it has taken them weeks to even respond in the first instance, with there being two emails plus two phonecalls.

The defence is due 7/5 and it is my intent to finish it tonight once i get back on my pc.

Having said that, i wouldn't file it without returning the call as it is significantly easier to amend before sending it in. Obviously they will be off for the bank holiday so it will be tuesday before you speak to them. Luckily i am around Wed/Thu anyway.

Thank you! When I called the last time I left a number for them to return the call and it took them, trying to think, must have been nearly a week if not a week. So I am not hopeful of getting through before its due. I was so frustrated!

If they wish to amend now then only agree if they give an extension for the period to file your defence pursuant to cpr 15.5

A word of advice about calling or calls. The only "debt" collector that actually phones people (as opposed to saying they did) is TNC Collections.

Recently MIL Collections have started calling people about their cases. It may be Gladstones are starting to do the same. But if they do call bare in mind that both MIL and Gladstones file claims without either any evidence or with flawed paperwork. The purpose of any call, apart from frightening people, is to get them to fill in the blanks in their evidence that are missing. In your case it would be the name of the driver. PCM almost always fail to meet the requirements for Keeper Liability. You are not liable, your husband is.

So if you do get a call, you can politely or impolitely tell them where to go. Or you can play them at their own game with the rather cheeky "What information are you missing and I'll see if I can help!" Make a note and hang up.

As with all calls, you don't give anything away and back it up with an email to confirm the details in case it's needed for evidence. In this case given the driver is someone other than the defendant then there would be no admission of the driver anyway, although if possible it's better not to name the driver at any stage so that they can't be chased at a later date.

Hopefully, they just want to sort their shit out though or it's a waste of time but we really need to see so nobody can accuse us of being unreasonable later on.
