            I would email Gladstones the following :-

            Dear Gladstones,

            Thank you for your evidence pack the contents of which are noted.

            I note that the witness refers to an area of land which has no relation to the particulars of claim. Further the signs bear no relation to the particulars of claim.

            Your witness states that the onus is on the defendant to obtain more information if the particulars of claim contain no information. This is not witness evidence. Aside from that it is untrue and when the defendant asked for more information this request was refused.

            The defendant did not accept the £100 as contended.

            I refer the claimant to the case they lost in High Wycombe B4GF26K6 & 2 others PARKING CONTROL MANAGEMENT (UK)-v-CHRISTOPHER BULL .

            My bundle and witness statement is currently being prepared, however should you wish to drop the case and limit the costs i will accept a drop hands offer should you wish to discontinue providing i have not sent my bundle.

              Use their witness statement formatting and create your own witness statement.

              Tell the story making sure you include all efforts to obtain extra information with copies of emails etc as exhibits.

                M1 I'm sorry I didn't get emails to tell me you had replied so I've just seen this when I logged in to check if I have to prepare the same! Thank you for the email to send to them. How long have I got to send this back to them? The newspaper article previously posted on here, is that relevant? Thanks again.

                  Sorry for all the questions, but whilst reading court cases with this all going on I remember reading that a sign should be displayed on entering the car park. Does anyone know what 'rule' etc this is? Or was it just a judges opinion. I'm desperately scrolling for it.

                    Send a bundle I mean.
                    The limit would be that ordered by the court. Usually no later than 14 days before trial.

                    I don't think it's law. It's contained within the relevant codes of practice. In the absence of entrance signs they would need to demonstrate that a driver should have seen a sign which either leads to another or in itself makes a contract. If not, they lose as there is no contract.

                      14 days would have been yesterday. They only sent me theirs on Tuesday so they will have to lump that! If I send it for Monday will that be okay? The set up of the car park is a joke. I've got photos.

                        Not really but it'll have to do. It might do you no favours if they're smart enough although given their wholly inadequate pleadings it might not matter.

                          Considering they've had months to send this to me with the first evidence I've seen I can't see how a court could say well yes you should have pulled that out within 3 days! I'm going to do it now.

                            Technically speaking, the judge hasn't asked them to so they didn't need to. You don't get evidence to reply to in a witness statement and evidence, that's what the pleadings are for, so you know the case against you. Of course the rules required them to plead a proper case, not such nonsense as they did.

                            Having said that they have no case so if the judge lets them away with such murder you should be ok with being a little late with yours.

                            Also the actual parking set up itself I feel is so ambiguous it stands a good chance on its own.
                            Whilst we will prep for this the actual parking should not matter a toss. The pleaded case is hopeless.

                              So I don't have to respond to anything in their witness statement? Should I comment the location in their witness statement is wrong? If you count today and count the day of the hearing that's 14 days I think. It's on Friday 30th? So it today the final day? (please, fingers crossed! Ha!)
