Re: Due in court in 2 weeks

    Sorry didn't see reply.

Attended court - case was stayed pending Beavis. Judge use to allow cases until recently. Feels now that word beginning with P has happened in the Beavis case he feels he has to stay cases until Beavis outcome, in line with what happened with Bank charges.

LPC requested costs be reserved?, Judge said no - ask him on what grounds within the small claims track 'rules' is claiming under? (can't remember the words used). Judge also noted it wasn't my fault the case was stayed so again no grounds for costs.

Was able to confirm with Judge that:
    1. fact that the redacted contracted was not signed is a non issue and wont help my case
    2. that parking eye can bring the claim under their own name & the usual arguments relating to that wont work

I will have opportunity to put new defence arguments forward when case resumes.

I wouldn't necessarily agree with the judge and it might be a different judge too. Many will agree with them though.

The stay was the important part for now though.

Re: Due in court in 2 weeks

stay for Parkeing Eye PCN County Court ended once the judgement on the beavis case was made.

At the last court hearing (when the judge stayed the case), the judge gave PE 2 weeks to ?continue with the case if they wished after the beavis judgement. That has passed, and I only received a debt collection letter from a different agency, but no official docs saying we are going to court.

Can I now put the case behind me and ignore all letters?

Wrote to court to ask them to confirm I can do the above.

When I called the court they said they have mot received anything from PE.

        Thanks

Depends on whether the claim was struck out on failure ( in the order).

Keep everything filed away, just in case.
