    Pe taking me to court over pcn via apn in a supermarket car park for overstay.

    If anyone wants to help/ keep a breast of the case then I am happy to post.

      Not pre-estimate of loss (no figures provided). no contract. Not landowner.

      Not or following practice direction. Need to determine the points.

      Refusal of adr.

      Redacted documents provided - Contract with landowner.


      Failing that hat request a stay pending beavis Supreme Court verdict.

        Beavis = You lose on this. (free carpark i assume)

        Not or following practice direction.
        That may be helpful as you could argue certain evidence is excluded but it's hard to say as you haven't really given much away.

        Refusal of adr.
        Unreasonable behaviour, costs only.

        Redacted documents provided - Contract with landowner.
        I'd argue with that myself but can see some judges not giving a toss.

        I'd be asking the opponent and court now.

                Thank you. I was finding it difficult to put the words together.

                if the case gets stayed will I have the opportunity to submit documents I will be relying on as well as other defence points?

                I can't do that now as there is less than 15 days until court date.

                    Great. Thanks. Letter for stay in the post today.

                    Do you know if we can email such letters to pe and court instead of sending via post.

                    The court guidance isn't specific on request for stay/correpondance being sent by email so close to court hearing date.

                        Also, re followup with call...nearly every time I try to call the court it just keeps ringing...they appear to be overstretch and choose not to pick up.

                            Tried calling the courts to see if they will be staying the case - no luck getting through despite calling them more than 7 times over the course of a day.

                            Looks like I will have to request the stay at court. Failing that make my case. Failing that pay & await Beavis supreme court decision.

                              Contact Parking eye and ask them too. If they agree email them and confirm details of your call just in case they screw it up or do nothing. (email them if they disagree too as the evidence will help on costs and unreasonable behaviour).

                              You could also either visit the court in person or phone northampton and get an email address for the local court.
