Yes, your home court. I think the questions are straightforward, but ask if you are unsure

The court will direct you to try mediation. At that point you can offer to settle for a small amount and see if they accept.
Mediation is carried out through a "professional" mediator via phone.
He/she will first ask the claimant for their version, and then phone you, ostensibly for your version.
At least that is the plan, but it doesn't always go that way.

I have downloaded the DQ to fill out. But I am not sure of the following, please help.

Sec E1 - name of the person attending the mediation appointment. Is that me or do I nominate someone on my behalf?
It also states I need to send the completed form to " the court at the address shown on the form N149A Notice of proposed allocation to Small Claims Track."

Is this the Civil National Business Centre. If not how do I find the address for this Court?

Assuming you are capable of attending the mediation, nominate yourself.

The case has not yet been allocated to a local court so send it to court address used when filing the defence

My mediation appointment is coming up soon. I also had a missed call from DCBL today!! Do I need to speak to them at this point or do I wait for the mediation appointment.

Also, not really sure what happens at mediation. I really would appreciate it if anyone could let me know how I need to prepare for this and what to expect.

DCBL possibly hoping to negotiate a settlement with you, but by doing it directly hope to frighten you into caving in!
I would not recommend initiating contact, and would decline to discuss the matter with them if they phoned.

The court appointed mediation is painless and takes less than an hour.
You will have no direct contact with DCBL.
The mediator will first speak to DCBL, and.see what they want.
He will then phone you and seek your viewpoint, and see if you are prepared to settle and at what figure.
He will then go back to BCBL and see if he can close the gap between their want and your give1
.... and continue shuffling until you either reach an agreement or an impasse.

By way of preparation you need to decide what is the maximum (if any) you are prepared to pay
Also a good idea to remember the main points of your defence: 1. they don't know the driver's identity so cannot proceed against him & 2. the NTK does not comply with PoFA 2012 and so cannot claim from the keeper

So, I attended the mediation appointment and out of goodwill agreed to pay a nominal sum as full and final settlement. I sincerely want to thank this site and DES8 for the advice given. I would not have been able to do it without you guys. Thank you again and I will make a donation
