Particulars of Claim: 1.The Defendant is indebted to the Claimant for a parking charge issued to vehicle # at #. 2. PCN details (details of the original PCN). 3. The PCN(s) was issued on private land owned or managed by C. The vehicle was parked in breach of the Terms on Cs signs (the contract), thus incurring the PCN(s). 4. The driver agreed to pay within 28 days but did not. D is liable as the driver or keeper. Despite requests, the PNC(s) is outstanding. The contract entitles C to damages. AND THE CLAIMANT CLAIMS 1. # being the total of the PNC(s) and damages. 2. Interest at a rate of 8% per annum pursuant to s.69 of the County Courts Act 1984 from the date hereof at a daily rate of # until judgement or sooner payment 3. Costs and court fees.
Is the debt Statute Barred (have you had any contact with the creditor or claimant over the last 6 years?): I have only had contact via an appeal to UKPC?
Any Other Information or Background Details: Parking charge due to parking longer than maximum stay. Parked at McDonalds drive thru at services and ate the food in the car. Car failed to start when wanting to leave, bought jump leads from petrol station located at the same services but workers at both the petrol station and McDonalds refused to help jump start the car. Due to it being late at night I had to wait a considerable amount of time for someone to arrive and help.
I submitted an appeal at the first opportunity, regrettably without advice, which was refused. The appeal stated the break down as the reason for overstaying the limit. I ignored multiple letters thereafter until receiving a court letter today.
I will be writing to the claimant/solicitors to obtain relevant documents, if any other details are required, please let me know. Any help would be appreciated.
