    Thanks, I hadn't noticed this and had already filed my Defence before getting your message. Do I need to apply to the Court to correct it or wait until the day?

    I did spot both of these things thanks ostell and included them in paras 11 & 12 of my Defence (above). Whether I was clear enough or quoted the legislation correcly I'm not sure?

    In the Claimant's Directions Questionaire they opted for mediation (I did not) and I have since received a letter from the Court notifying me of the allocation of the case to the Small Claims track at my local court and with a date for telephone mediation in May. Is that to be expected?

    I also noticed in their DQ that they entered zero in box D3 - no of witnesses givinng evidence at the hearing. Does that mean they don't intend to attend the hearing should it proceed?
