    Hi Guys,

    I need some advice. I have a county court claim for an unpaid PCN and I want to fight it as I think its unfair and disgusting how they prey on people. I have sent across my AOS and have until 18th March to defend my case. I don't really know where to start and whether I even have a leg to stand on??

    The particulars of the claim are:

    The Driver of the vehicle with registration ****** (the vechile) parked in breach of the terms of parking stipulated on the signage (the contract) at Dickson house Alencon Link Basingstoke on 28/04/2019 thus incurring the parking charge (PCN). The PCN was not paid within 28 days of issue. The claimant claims the unpaid PCN from the defendant as the driver/keeper of the vehicle. Despite the demands being made, the defendant has failed to settle their outstanding liability. The claimant claims £100 for the PCN, £60 contractual costs pursuant to the contract and the PCN terms and conditions, together with the statutory interest of £9.23 pursuant to the s69 of the county courts act 1984 at 8.00% per annum, continuing at £0.04 per day.

    I have attached the parking signage of which I took a photo of the other day so I would assume this was there at the time! I parked there on a Sunday which as you can see you only get 30 mins max!

    Please can someone help, do I have any leg to stand on and dispute this?

      So let's see the sign and a redacted copy of the PCN* leaving the dates*

      Edit so that the identity of the driver cannot be inferred, use "the driver......." etc

      Search around for suitable defences, herecand the pepipoo forums

        ostell for some reason I can’t seem to upload photos on here? I’ve tried every hard to find a similar issues on the forum but it doesn’t seem to be very easy

                  The failure to pay the PCN is the basis of the claim so it is important!!

                    Okay I will call them on Monday and ask if I can have a copy, from memory it’s because I parked in short stay and exceed the 30 minutes on Sunday

                        so I need to get the PCN which I will try do tomorrow but what do you mean by the below?

                          To hold the keeper luable then they have to jump through the many hoops of POFA to do that. If they know the identity if the driver then it makes things a lot lot easier for them.

                              So did you receive a Notice to Keeper?

                              A letter to the solicitor requesting all the documents that they intend to use in court in order to narrow the issues between you, as expected by the courts. You expect these by return and in any case within 7 days.
