  • Premier parking fine notice

    Hello
    i have today received a letter from PPLEGAL acting for premier parking demanding payment for a parking fine sent to me after I parked at pier head Exmouth Devon , I appealed the fine as I was blocked in the car park by a breakdown van dealing with a car with a problem in the car park I explained this described the van as they must have a record of it on their cameras I also have my ticket which shows I paid and was only just over my time because I was stopped from leaving now not hearing from them since my popla appeal I have been threatened with court if I do not pay in the next 7 days advice someone please.

    Which Premier Parking? (There are several companies with similar names.)

    When did the alleged contravention take place?

    Do you have the postal notice to keeper? (& if applicable, the windscreen notice to driver.)

      sorry this was premier park , there was no windscreen fine it arrived in the post, I have the ticket I bought, I was back at my car in time left the bay but had no way of leaving the car park until a vehicle opposite the breakdown moved the original notice stated basically ticket not purchased after I sent them proof their wording changed on their next notice all appeals were declined including popla and I have heard nothing until yesterday’s demand from these legal people.

                  So if it gets to court then part of your defence will be frustration of contract. You had ever intention of complying with the contract but events outside of your control prevented you from completing the terms of the contract.

                        they are saying I entered the car park at 20:02 I purchased the ticket at 20:08 paying for 2 hours they have me leaving the car park at 22:20

                              Shame you've inferred who the driver could be and left all your details in the PCN. That PCN fails on many points to be able to hold the keeper liable.

                              9 (2) (e), the invitation, is not there, 9 (2)(f) is wrong and not in the required format, the creditor has not been identified 9 (2) (h).
