  • EXCEL PARKING - Two tickets in one day

    Do I have any chance of defending the attached. I received two for the same day - one visit 19 minutes, the other 17 minutes. The photos of the car only show it entering and exiting, not actually parked. It also a Hirer notification.

      presumably you were the hirer.

      sorry, but can hardly read that attachment. Could you possibly post it on a hosting site and give us the link.

      also, please advise i) the date of the incident and ii)was there any other documentation sent you?

        Thank you for coming back to me. Technically yes, the car is on a hire purchase agreement. I have attached a new scanned version which should make it easier to read.
        Date of incident was 8th April and the issue date was 8th May.
        No other documentation was sent to me - obviously I have two of these PCN's - two different instances but on the same day. Thanks in advance for your help.

          Thanks for the clearer picture.

          I'm a bit confused now (easily done!)
          I assume the vehicle is registered with the DVLA in the hirer's name.
          You say the vehicle is on hire Purchase, which normally means the registered keeper is the purchaser
          Could it be a lease purchase rather than hire purchase?

          As the vehicle is "on hire", when the parking company try and transfer liability to the hirer there is a whole bunch of conditions with which Excel have not complied.

          When the purchase method has been confirmed we can suggest a suitable response to Excel (which they won't accept as valid, but never mind it starts the defence)

          Do not identify the driver, either on here on when contacting Excel

            Yes please accept my apologies, it is in fact a hire agreement / lease.

              You could send them the following letter, but not until 29th May.
              The reason for delay is to ensure they are out of time to correct their error!

              Dear Sirs,
              I have received your Hirer Notification dated 08.05.2026 for vehicle VRM xxxx

              You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to include the documents as prescribed by section 14 (2)(a)of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the hirer.

              There is no legal requirement to name the driver at the time and I will not be doing so.

              I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.
              Yours etc



              As said previously, they will probably continue to seek payment so anticipate a dispute

                I will send this on the 29th for both PCN's. PCwhen they deny my defence, as you suggest they will, what are the next steps?

                  They will probably request you pay and threaten further action if you don't.
                  Generally it starts with toothless debt collectors, moves possibly to tame solicitors and then even court action, which may or may not be discontinued prior to the hearing.
                  Sometimes they just don't turn up at court.
