PCN issued to keeper. Not the driver of the vehicle at the time

  • PCN issued to keeper. Not the driver of the vehicle at the time

    I was issued a private parking PCN to the keeper by PCM. Originally I appealed on behalf of the driver as many claims over signage and duration of stopping being 30 secs or so. This was rejected. I since provided the details of the driver at the time, so the PCN against my name was cancelled but the company is refusing to accept them saying that the address is not serviceable and there is compelling evidence that I was the driver of the vehicle at the time. My question is whether this will continue to court. I don't want to receive a court summons when wasn't the driver at the time, and so far as I'm aware the charge cannot be issued to be if I have named the driver. Any advice on how to proceed?

    So where was the address?* Abroad?

    If you have named the driver at the time and given a serviceable address then they cannot hold the keeper liable through POFA.* POFA 5 (1) (b) is no longer applicable.
