PCN Newcastle Airport - Byelaws, Charged for stopping

  • PCN Newcastle Airport - Byelaws, Charged for stopping

    Hi,

    As usual advice please.

    PCN issued at Newcastle Airport for breach of byelaw 6.3 - Parking in Prohibited area. Now there are two lanes which go into the car park for picking up and a third lane which directs you to turn right into a hotel as shown in the image below. The driver was collecting passengers from the airport and was trying to navigate to the correct car park for pick up.

    The right lane was taken to turn into the hotel to turn around but as the driver stopped to let traffic past the driver saw there there was tons of signage around saying you cant do a U turn, you cant stop, you can't do this and you can't do that. As shown in the image below:

    So the signes indicate that you have to go into the hotel, you can not u turn and you can not stop there.

    By the time all of the signs were read and processed to work out what the driver could and couldn't do the engine stop/start had kicked in. The vehcile has had trouble with the engine stop/start previously and causes the car to stall and not restart on occasion. A breakdown/recovery service has been contacted a couple of times in relation to this and the problem is intermittent.

    Whilst the driver was making attempts to restart the vehicle the people being collected noticed the problem and came over the vehicle to asisst, this was without the knowledge of the driver until they were actually at the vehicle. They got into the vehicle and provided advice as to what may be causing the problem and after several attempts the driver was able to restart the vehicle and turn as directed into the hotel.

    Once at the hotel there was a barrier which stated that the car park was for custmers only and non customers were basically not granted entry. IMage below:

    This then again caused the driver to read the sign and thus had to wait for a few moments to digest what the instructions were and so had to then reverse back out onto the road and go the opposite way out of the airport.

    The rear states "Under byelaw 3.3.1 the registered keeper is immediately held liable for the sum due" surely that can't be right in any case?

    Byelaw 6.3 states:

    PROHIBITED ACTS ON PRIVATE AIRPORT ROADS ETC. On any private Airport road or other part of the Airport to which the Road Traffic Enactments do not apply, no person shall:

    Wait in, leave or park a vehicle where waiting or parking is prohibited by notice.

    So look around in the pepipoo forum for the many Newcastle Airport Threads.

    I think you will find that RTE applies to that road. The public have full access to it.

      When was this taken as the sign shown is incorrect - minimum charge is now £2 for the first 10 minutes.

        The image was taken from google maps so is likely incorrect.
