  • Parking eye debt recovery plus

    I overstayed my welcome in a car park a year ago and received a parking eye fine which I ignored. I had had multiple letters from them with the fine increasing etc and I have ignored every letter. I have now had a letter from Debt Recovery plus called "letter before referral for legal action"this stated I could pay £160. I then had a letter a few weeks later saying I could pay a reduced fine of £130 and another letter saying I now owe the £160. I am concerned if I do actually get taken to court as this is obviously going to cost lots of money and I don't want to have a CCJ. Am I correct to keep ignoring? A year to receive these letters seems ridiculous. Also if I did get a letter from the courts would I have the opportunity to pay then instead of going to court? Any advice would be greatly appreciated as it is very distressing to receive such letters.

    Only letter before county court actions or actual court claims need a reply.

      You only get a CCJ marked against you if they take you to court and if you lose and if you don't pay within 28 days. The court costs is are the charge plus solicitors fees capped at £50 plus possibly a small amount of interest.

        Thank you for your reply. If they do say they are taking the you to court and you receive a court letter can you then pay or would I be forced to go to court and pay the fees etc?

          If they initiated a court claim, you would have the opportunity to appeal/defend the claim before you would have to pay (and only that if you lost )
          Debt is like any other trap, easy enough to get into, but hard enough to get out of.

          It doesn't matter where your journey begins, so long as you begin it...

            I wouldn't want to appeal as I know I shouldn't have parked there so don't really have a leg to stand on. So the best thing to do is continue to ignore and if I do actually get a court letter then just pay?

              For a typical PE case you are talking about £175 (for a £100 ticket) if you lose in court.

              It really is up to you how far you wish to take matters if you decide to pay.

                Well I currently owe them £160 anyway... What is the likelihood of them taking me to court?

                  Exactly !

                  They do take quite a few to court but usually the ones that do don't go to DRP although that's not a promise
