  • Do Premier Park Ltd have right to fine for parking on private land?

    I have received a letter from Premier Park Ltd for parking on a gravelled area adjoining a pub at which I had parked. Their letter states:
    'The terms and conditions of parking on this private land are clearly set out on the signage installed within the car park.'

    There was no obvious car park to be seen. I had just parked on a gravelled apron near the pub where I had gone with family for a drink.

    (Interesting paragraph further down their letter: 'If within 28 days we have not received full payment or driver details, under schedule 4 of the the Protection of Freedoms Act 2012, we have the right , subject to the requirements of the act, to recover...etc etc, whatever that all means)

    It means that as they do not know the name of the driver they can hold the keeper liable for the charge if it's not paid within 28 days.

    Check that the Notice to Keeper (your letter) complies fully with the requirements of paragraph 9 of POFA.

    Go have another drink and take some photos of the signs (or lack of) especially at the entrance

      I would only buy said drink if the manager cancelled the ticket

        Thanks, I will check POFA. On their letter they have included a photo of one of the small signs - the heading says: WARNING PRIVATE LAND. I cannot read the rest. I have called the council concerned who have confirmed it is nothing to do with them. My wife is concerned that if they went 'all the way' with this and she ended up with a CCJ it could effect her job, which is in a sensitive area.

          CCJ only harms people when unpaid. You have to lose then not pay within 28 days for your credit file to be harmed.

            Hi mystery1 and ostell,

            I visited the pub today and took a photo of the sign nearest where we had parked - copy attached. When we called the pub they stated that Premier are commissioned by Devon County Council. However when I called them they confirmed it was nothing to do with them. Any further advice for me please?

                Hi ostell and mystery1, Having seen a permit in another vehicles window, I emailed Exeter City Council and have a reply from them as follows:

                'Dear Mr Ford, I am sorry but the Turf public house have misled you in thinking that the parking is managed by Devon County Council, do you know who you spoke to as I will need to make sure they are informed correctly. Exeter City Council employ Premier Park to manage the car parking for Exeter Waterways which include the land around Turf locks, the photo you showed of our parking permit is strictly controlled to a very few vehicles for employees of the Turf Locks Hotel only. Any further correspondence regarding the letter you had from Premier Park will need to be taken up with them.'

                This sounds like I will have to pay??

                  Could be even better than you thought! This is council land possibly with a Parking Place Order (?). The land is still owned by the council and therefore could well be not relevant land for the purposes of POFA and therefore cannot hold the keeper liable.

                    Sounds like the council are worried that someone is claiming that something is council when it's not in case they rack up liabilities. What is difficult to understand as i don't know the area is whether the land where the ticket was issued is close to, the same as, or distinct from the council land.
