  • Smart Parking Fine - HELP

    This is a complicated one

    Received a letter from Debt Recovery Plus Ltd on behalf of Smart Parking Ltd asking for £70 and saying its too late for appeals, however the original parking charge notice was never received at the Registered Keeper's address.

    The registered keeper at the time was not driving, and is having nothing to do with it as Smart Parking looked up the regsitered keeper at the time DVLA hadn't recieved/updated the new registered keeper yet. I just got forwarded the debt recovery plus letter which i have double checked is the only one he has recieved.

    The van that was parked has now been sold again and isn't in my name.

    I also don't even know what the fine is for.. it just says over free time which i dont think the driver did

    The registered keeper is the one they will attempt to chase so ultimately they really should deal with it although if they name the driver that doesn't help the driver.

    Dear Sirs,


    I have today received a letter from xxx regarding an apparent parking charge notice. This letter today is the first i have heard of the matter and as registered keeper i note that this contravenes the statutory requirements of the protection of freedoms act 2012 schedule 4 for keeper liability.


    I would appeal as registered keeper but note that there appears to be no option to do so. In light of this please contact the driver.

          That's who debt recovery plus sent a letter to, yes. Then he said to them to deal with it through me as he wasn't in possession of the car at that time. He gave them my name and address and I've tried to appeal it online and they said "we can confirm that a PCN was sent to the registered keepers address and it's too late to appeal now" OWTTE and ignored the fact that I dispute the original fine anyway. So I said "I can confirm it was never actually received at the registered keepers address and therefore the 28 days isn't over and therefore I would like to appeal my fine and for you to withdraw the submission of my parking fine to debt recovery plus because the original fine was never received" and they just basically told me to speak to debt recovery plus.

                Gotcha. If he has proof just get him to write back telling them he gave them the drivers details already andhe has no liability so they can go forth and multiply.

                He should ignore all bar court papers (or grow a pair and eventually sue for harassment)

                  But they are contacting me about it directly now via email. Will they chase me up with the debt collectors? I just want them to withdraw their notice in the first place. I've asked for evidence of me staying over the free time and they keep completely ignoring that but why would I pay a fine which I contest without any evidence. They could be making it up
