  • Asda overstay Smart Parking disabled driver

    I am a disabled with mobility impairment and other mental illnesses, I was at shopping a different ASDA instead of my local Asda... It takes me much longer than the abled bodied person, on this instance I had my carer with me as she lives closer she was helping me try on clothes as this is something that I cannot do on my own.. Thus taking even longer than a normal shop. After that we had to do a food shop. Because of the effort this took me I took a funny turn and needed to rest a longer than normal. I suffer with several conditions and illnesses one of them being dizzy spells.. I could not drive for the moment and we had to either wait for my attack to subside or wait for my husband to get to me..we knew we were running near to time, we couldn't remember what the exact time it was we came in, my carer asked an Asda employee if it was ok that if we ran overtime, she explained that they did not run the car park and if I did get a ticket to explain my predicament, she did ask if help was needed and we stupidly declined it was not an emergency and nothing they could do, I had also had an incontinence accident and was very embarrassed....meanwhile Whilst we were waiting for my husband who was working nearby I was feeling a bit better and decided to make the move to drive on. I have enclosed evidence of receipt of goods at asda and blue badge and can include any paperwork if needed, what do you think my chances for the appeal being accepted.. I worry extremely and cannot afford the fine I find paperwork and having to deal with these things really distressing.. The fine is £40 the date of the contravention was the 29/7/15 but I received the letter on the 10/8/15 so only giving me a couple of days to sort as the registered keeper is motability I presume they received the fine first? This then goes up to £70.. All for staying 32 mins over.. Thanks

      I myself would send a letter to the manager of the local Asda store explaining what has happened and getting them to phone this car parking company to cancel the ticket. They have the ultimnate responsibility as the car parking company are acting under their authority and the buck stops with them.

      In your letter tell them you are registered disabled and that reasonable adjustments needs to be applied in this case as to an able bodied person. Asda will need to show an "Objective Justification" to continue with enforcement measures under the Equality Act 2010

        [MENTION=5354]mystery1[/MENTION] is the best person to advise you here ... he'll definitely suggest you appeal the PCN (with you asking them for a popla code if they reject your appeal) :nod:

        It might also be worth 'shaming' asda on social media in the mean time, to see if they will intervene and get SP to drop the charge for you xx

          Thank you guys for your reply, I really appreciate any advice given.. I have since emailed the directorate@asda.co.uk explaining my situation but I've also read they do very little or nothing it may well be accepted who knows but just wanted to prepare next step find out all info. I find it hard to talk about my problems so thank you..what's unreal is my carer who also took her car stayed same time as I did and got nothing! I will write to local store manager too..
