  • First ever parking charge notice - please help

    Hi guys

    I am a fairly new driver and have only been driving for half a year. As such I am pretty cautious about doing wrong things on the road.

    Last week we (mum and sister) went to Birmingham to enjoy a day out and in the evening we decided to do some food shopping at a store called A1 supermarket in Small Heath before heading back home.

    Today I received a parking charge notice from Civil Enforcement ltd. As you drive past the supermarket, there is a massive billboard saying A1 Supermarket and then it says free parking for customers. I saw this sign and that's the reason why we decided to shop at the market. Inside the car park there was another massive sign that said free car parking for customers and then on the other side of the car park, I could make out another sign that said something like parking for 1 hour - no return or something along those lines. However I didn't focus on that sign as the other signs were saying free parking for customers.

    My mum and sisters then went into the market and shopped and I stayed in the car. We didn't think about the one hour limit and my mum and sisters then come out an hour or so later, at which point we decided to have a bit to eat in the car before heading back home with a long drive.

    Also there was no payment machines at all to even pay a ticket or anything.

    This then brings me onto the parking ticket itself. The ticket says to pay £100 or £60 if paid within 14 days. However there is no name of the company, no address to challenge. And in the terms and conditions it says if your challenge is rejected, then you have to pay the full charge and won't be eligible for the reduced rate.

    Appeal - something along the lines of:
    Dear Sirs,

    I, as registered keeper, wish to invoke your appeals procedure. The driver was at that time using the store. As the signs say "free parking for customers" there was no obligation to purchase a ticket. There were also no ticket machines in the area. In any event your charges are penal in nature and not a genuine pre estimate of loss.

    I am under no statutory obligation to name the driver and will not do so.

    If you reject my appeal please supply a popla code.

        I have further pictures of conflicting information about signage.

        Also one other thing I noticed is that although they have obtained my details from DVLA, they have failed to spell my name correctly.

                Definitely

                Start with what Kati suggested, a simple letter/email to the company that Kati provided that has issued the PCN to you. If you get a reply then post up a redacted (remove your details) version for Kati and Mystery1 to see and they will be able to advise.

                Alternatively pay the £60 or £100 penalty for the free parking you should have been entitled to...

                  She did pay by card so I will try getting the statement. The other issue is that the actual charge notice has no details of the company at all. I managed to get an email off the payment website where I will email the appeal. However they have not left a lot of information on the letter at all. I will post up a copy of the charge.

                              Get pictures to show they can't be seen in the dark if you can. If it's dark and they would not have been seen by a reasonable person there can be no contract and you should win.
