  • Parking charge notice - Civic Enforcement Ltd

    Could someone offer me some advice please? I have received a parking charge notice from Civic Enforcement Ltd. My family and I parked in their car park for 14 minutes, I remained in the car whilst my husband popped into a shop. We didn't realise it was a proper car park as it looked like waste land. As we left we noticed a sign saying you had to pay by phone, so as we drove away we called the number, registered our credit card with the company and entered the number of the car park. The automated message gave us a car park in a totally different part of the country and when my husband pressed to say that was incorrect it cut us off. We now have a fine for £60 if we pay promptly.

    I don't know what to do as I feel £60 for 14 minutes is ridiculous but don't want to get drawn into a long process that will cost me £100 in the end.

    Dear sirs,

    I, as registered keeper, wish to invoke your appeals procedure.The driver did not see any signs until exiting the car park when they saw 1 sign. At this point the driver tried to pay by card but the automated system said it was the incorrect car park and when the number was pressed for this option the call ended. In any event your charges are penal and not a genuine pre estimate of loss.

    I am under no statutory obligation to name the driver and will not do so.

    Should you reject my appeal please supply a popla code.

    Yours etc

    If you get a popla code come back for further advice.

        We have received a letter stating that the fine will not be cancelled. We need to go to POPLA. Could you offer me some advice please? I would thought the fact that we registered our card on their system and tried to pay would show it was a mistake. Also we were only in the car park for 14 minutes.

              I haven't been able to scan the letter but I have taken a photograph, hopefully you will be able to see them correctly. Thank you again for your help, I am very happy to make a donation to a charity of your choice as a thank you for your time.

                  Ok. POpla is now a far riskier path than pre Beavis. You can pay £60 or risk popla and end up owing £100.

                  Until we get some results from popla we simply do not know how they will incorporate Beavis in to their thinking, including if they will distinguish Beavis as in Cargius, or rule upon the notice to keeper points i'm now advising. (your appeal would be pretty similar to http://www.legalbeagles.info/forums/...577#post539577 ).
