      Hi M1

Just amending the letter you sent me. Toward the end it mentions asking them to get popla involved, since I already had my popla appeal rejected I will omit this part however can I leave the part about the beavis appeal result or is it the same thing?

Correct. Delete popla leave Beavis. Totally different.

            excel parking

            Hi
I can't find my original thread. Basically I have received another letter from excel lots of sheets of paper and photos. In response to the email I sent to them, kindly given to me by a very knowledgeable member on here. I am hoping for some more help please. They are still insisting I pay the £100 pound but have backed off with the court talk. What do you think my next move should be please?

Depends what they are saying really. Did they acknowledge that a ticket was purchased ?

                hi

They don't acknowledge it but in the popla report it says "i note that the appealant. Did purchase a ticket on the day of the incident"
It seems strange how they have gone back to the softly softly approach now? I have taken photos of the signs at the car park and it only mentions putting the right reg number in small text on the machine itself. Not on the big signs it's almost as if they are trying to catch people out.
Sorry I can't find the mention button mystery 1.
Trying to do this on a smart phone. Hence some of the questionable spelling and grammar.

Mention button is the last icon above the box for typing your message. Funny blue disc type thingy. You only need it if it appears i've missed you anyway.

If they try court on a mistype reg they'll have a hard time when they have to say it's not a penalty. I'd probably start filing everything bar real court papers now. Otherwise it'll drive you mad.

another point to bear in mi9nd if they do go ahead, you mention that there was nothing on the signage about inputting the correct reg no but a small notice on the machine itself. If a unilateral contract is to be offered and accepted all of the contract must be available on intlelligible in the one contractual notice. By having unmentioned clauses as separate condition on the machine it renders the first notice to be an "invitation to treat" instead of a contract. The difference id that you can accept or decline the further contractual terms and by parking how you want and enetering any old reg no in the machine you have declined to enter a contract. That doesnt mean that you cant park there, that is no longer for them to decide upon.

                        HI

I have finally had another letter. This time its from DRP.

NOTICE OF INTENDE COURT PROCEEDINGS. THE CHARGE IS NOW £160.00

The company is called debt recovery plus. I have all letters from the beginning of this ridiculous farce of a case. Would you mind telling me what you think my next move should be.

                        Regards Craig

DRP will not and cannot take you to court as there has been no legal assignment and they do not own the "debt".

                          File and ignore.

                            Thank you

I thought they had given up on it to be honest but hey ho. I will file it and come back to you. I have ti 21/5/15 to pay the £160.00 they will then pass my file to a creditors solicitor with a recommendation to commence court action!!!!! then in bold and in caps a court judgement against you could seriously affect your ability to obtain credit in the future. Bless them they are trying.

Thanks agin and will come back to you.

                            Regards Craig

                              Hi Craig2380,

Have you heard any further from the debt collection agency with regard to the parking "invoice".

I only ask as I have just received one myself and would like to know how they have proceeded.

                              have court proceedings been issued?

                              Thanks

                              Hobo
