    Hello,
    I was at a parking eye car park. The sign read to download an app called Evology.
    I downloaded the app and put in my details including bank card. When I got to the "Pay to park now" screen, there were 2 buttons to press, see picture.
    This looks like extortion to me. It was impossible to choose the option "No, pay now" I tried and it went back to the previous page and I had to input my reg details again.
    I tried several times and gave up as I refused to be extorted to pay extra for a dubious payment to a "NHS charity".
    I decided to leave. Apparently I was in the car park for 14 minutes. I don't think this is unreasonable as I was trying to pay.
    Any advice is greatly appreciated. Thanks

      By all means appeal to PE on the basis the app misfunctioned.
      However they are unlikely to accept your appeal as valid ('cos that doesn't increase their coffers!), but you might then be successful in an appeal to POPLA

      At this stage don't identify the driver when communicating with them.

      Could you post up a copy of the NTK (redacted but leave in all dates and times) ... they might just have made a mistake on it, (altho' PE do usually get it right)

          I trust you didn't identify the driver in your email to the App company as you don't want to run the risk of PE discovering the driver's identity.
          Don't mention it in here either, as the parking companies are known to follow these sites.

          That NTK did not comply with the POFA 2012 mandated requirements to pass liability for parking charges from driver to keeper.
          PoFA 2012 sch 4 para 9 sec 9 (2) (a) states:
          "The notice must—
          specify ....... the period of parking to which the notice relates;"

          Their NTK states the time of entry to and departure from the car park, which is not the time parked.
          A small point, but get the right adjudicator at POPLA or judge in court and you win.
