  • DCBL 4 year old parking charge and threaten letters

    Afternoon everyone,

    First time I've made a post here regarding a parking charge I received from 4 years ago this June. I've been looking for template letter to dispute the charge like anyone who's turned for help here. I've ignored it up to now and kept hold of my paid parking tickets in preperation they didn't cease and desist. I paid for parking but not enough time. we were a hour short. So on return to the car I paid for another hour and immediately left.

    They claim that no payment was ever made which I can prove otherwise if it comes to it. However, I much prefer to use the templates to wear them down so they go away.

    Any help is greatly appreciated

    In my experience the only way to make DCBL go away is to pay them!

    DCBL are only debt collectors and ignore any representations they receive.
    Their side kick, DCB LEGAL, is slightly different as they are solicitors.
    They don't take any notice of representations, but will initiate a court claim which can then be defended .
    Generally, as long as the defence is robust enough, they back down and eventually either discontinue the claim or don't turn up for the hearing!

    I am not aware of any templates, here or on MSE, which you can use to make them give up early.
    It just isn't in their genes!

      I'm hoping that as I live and the "offence" took place in scotland according to them, that Scots Law may keep them at bay and court proceedings aren't the same when issued in england.

      I was so sure I seen someone tag some letters templates when requesting freedom of information regarding details of the offence etc

        As you are in Scotland it is a different ball game to England & Wales

        Just write and tell them that as keeper of the vehicle you are not naming the driver and the keeper cannot be held by default in Scotland as POFA2012 does not apply.
        Please go away and remove my details from your data base.

        Just make sure you do not reveal identity of the driver

          I have tried to tell DCBL this on the phone but usual they just kept asking if I was going to pay it or not. I haven’t disclosed any personal details as to who was driving, other than mentioning it could have been a cousin who lives in New Zealand, and I was away in for work in Aberdeen at the time of the alleged offence. I’ll try this approach and see where it goes

            As mentioned earlier DCBL are just bottom feeder debt collectors who want the money and will ignore any representations you make.

            Advice is to never ever phone these people.
            Any communications should be in writing.

              I’ve had a response from parkingeye when I sent them the same email, as I did to DCBL about refusal to name the driver and remove my details:

              We are writing in relation to your below enquiry.

              Please be advised our complaints policy does not cover the following:
              • Appeals/dissatisfaction relating to the issuance of a Parking Charge Notice
              • Complaints which are received 56 days after the charge was incurred

              It is Parkingeye’s position that the charge was issued correctly and that we had reasonable cause to request the Registered Keeper’s details from the DVLA following a breach of the terms and conditions of parking in operation on site. For your information, we are registered with the ICO to collect and process data for the purpose of car park management, which includes dealing with appeals and any subsequent recovery action required.

              We therefore wish to confirm that we have rejected your request that we remove data from our system and cease processing in this instance at this stage.

              Please note you have the right to make a complaint to the ICO in respect of this response, should you wish to do so. You may also seek a judicial remedy.

                Not surprised at all
                As said in post 2 all they want is your money

                However as they do not know the identity of the driver they are up the river without a paddle.

                Don't waste any more time or effort writing to them until you hear from DCB Legal (or possibly some other law firm) who might realise they cannot sue in Scotland the registered keeper for unpaid parking charges

                Obviously do not, above all, identify the driver (even on here as parking companies do follow these sites)

                  Low and behold, Last week I received a letter from DCBL legal regarding this but I'm not sure what direction to go in now. Despite previously ignoring and refusing to provide information to DCBL, I'm now being lettered by DCBL Legal...

                    P;lease post on here the letter you have received after covering up your name, address, vehicle registration number and all reference numbers that could identify you.
