  • Britannia Parking PCN - late issue

    Hi all,

    Received a parking charge notice from Britannia parking for parking longer than the permitted stay in a Waitrose car park.
    Looking at the dates of the offence it seems its been issued to me out of the 14 days.
    Date of contravention: 04/05/2024
    Date of this notice: 20/05/2024
    Received in the post: 25/05/2024

    I also don't see any mention of the Protection of Freedoms act on the form. attached these for reference.

    Do i have a good case to appeal?

      Assuming you are the registered keeper send them this:

      I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

      You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act.

      You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper
      .
      There is no legal requirement to name the driver at the time and I will not be doing so.

      Any further communication from you on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.

      Do not identify the driver, even on here

        Many thanks for the reply Des.
        Can i ask from your experience what the chances this will be the last of it as i really don't want any further stress or anxiety with further letters from them and potential court hearing.
