  • PCN - Possible late notice

    Hi all. Long story short, i received a PCN from Britannia Parking. The contrevention was on 29th June, the "date of notice" was 11th July, but the latter didnt reach me until today, 17th July, way past the 14-days. Is this enough to appeal??

    If a s9 Notice is dated (Tues) 11th July, it is likely to be deemed in law to be served by (Thurs) 13th July, so unfortunately just in time.
    If you state otherwise, the burden of proof will switch to you to prove the contrary.

    9(6)A notice sent by post is to be presumed, unless the contrary is proved, to have been delivered (and so “given” for the purposes of sub-paragraph (4)) on the second working day after the day on which it is posted; and for this purpose “working day” means any day other than a Saturday, Sunday or a public holiday in England and Wales.
