  • County court claim form - Civil Enforcement Limited

    Hi,

    I received a "county court claim form" from Civil Enforcement Limited. In the claim they state they will provide detailed particulars within 14 days after service of the claim form. The Claim is dated 31st May. I have registered I intend to defend the claim on the moneyclaim website but they have failed to provide the detailed particulars within the 14 days, how do I defence this claim?

      Hi Mike

      I'm assuming this is to do with an invoice for an alleged parking contract breach.
      You should have received the fuller Particulars by now, I would have thought.
      Was this claim via MCOL?

        Thanks for your prompt response, yes it's related to parking, it was via MCOL but no particulars have been received? I didn't know if I should contact Civil Enforcement and ask them to email the details to me?

          I wouldn't, if it were me!
          They brought the claim, it's they that initiated the timeframe for dealing with it.
          Why help them to manage their own case?

            Thanks for the advice, is there a particular way to lodge a defence whe no details are given/received? Are they duty bound to honour the 14 days or is this time scale just advisory?

              They are bound under Civil Procedure Rules.
              The court does have some discretion in this, but they are tending to get tough on miscreants who cannot provide a good explanation for their tardiness.

              (Btw, I'm not Kati. Kati is far wiser & better looking than me! )
