  • HELP Mystery1! Taken to court by Parking & Property Management Ltd

    Hi Mystery1

    I've had a read through some forums but my court claim form is a bit different so need your help

    1. I've attached letters showing the claimant is Parking and Property Management Ltd - is this a company others have had experience with?
    2. In the particulars of claim section on the first scan, it doesn't say that particulars of claims will be sent separately within 14 days - I hope this isnt all they're sending?

    So I'm not sure if I should do the acknowledgment of service now or wait for particulars?

    what are your thoughts?

      There is no mention of further particulars to follow, so acknowledge asap.
      Do you have the first postal Notice to Keeper?
      Do you have images of signage?
      Is this a situation where tenancy of the property might be involved?
      Was there a windscreen ticket? If not, how was the alleged parking event witnessed?
      Did you do the appeal to parking co/appeal to independent body?
      Have you 'outed' the driver's ID?

        - I can't say with certainty who was driving the vehicle at the time as it is not always me - all I know is it definitely wasn't me driving or parking in this area, I'm sure I would have recognised it!
        - I don't have the postal notice to keeper or images of signage
        - no tenancy of property involved
        - I rang up the company issuing the ticket and they say a ticket would have been placed on the windscreen (again, something I'm sure I would remember peeling off if I was driving!!)
        - I haven't appealed to anyone yet or outed the drivers ID (I can ask a few potential drivers but thought I'd check what to do with you guys first?)

        I'll acknowledge first thing tomorrow, but seems a bit unfair I'm having to go through this when it's nothing to do with me..? Yes I am the keeper of the vehicle, but this is the first I'm seeing of this! Should I find out who was driving and have them deal with it? (if this is even a possibility?)

          Hi

          I have done the acknowledgment of service, giving me an extra 14 days to fully dispute the claim, but If there are no particulars to follow, what can I argue my case on?

            I don't have the postal notice to keeper....
            Why?
            Was it binned?
            Or didn't you receive one? & if not, can you think of any reason why? (Eg. You may have moved address & not updated your details with DVLA etc etc).

            ....or images of signage
            The signage is what the parking contract with the driver is supposedly based on.
            So it's important to take a photo of the signs on site. (Do not rely on stock images that the parking companies sometimes disclose. There may be differences between the stock photo & the one's actually displayed at the site.)
