    You can certainly add in about the battery as it adds credibility to the "no contract" defence. (frustration of contract if the court says there was a contract but no need to be technical yet).

        Just to update anyone who cares or may be reading this. I've emailed Wright Hassal with the above and added in some of my own details @ their email email@wrighthassal.co.uk that I found online.

        I will keep the thread updated with what happens in the forthcoming future.

          Hi all,

          I sent the above letter pretty much to Wright Hassal and added in some extra details regarding my faulty battery etc and they have just mailed me back and I am unsure on how to reply to them and have only been given "14 days" before they proceed with "litigation". So any help as soon as possible would be greatly appreciated.

            Thank you for your letter of xxx the contents of which are noted.

            I specifically note that your pursuit is against me as keeper and that you do not think that the byelaws are a problem. They are a problem.

            Further given your client has accessed my without a reasonable cause i will strongly consider a claim for a breach of the data protection act.

              Thanks alot M1, I'll send that off to them nearer the end of the 14 day period I have.

              I take it that 3rd line is meant to say "accessed my personal information without a reasonable cause" ?

                    1st paragraph of their letter mentions about an incorrect name. You should reply to that too, as appropriate.

                        Read the parking cowboys link. It'll explain it way better than i could.

                        I'm not sure it would be right for you though as you'd need to present a case to the court. It might be enough pressure to get them to back off though.

                          Hey all and Hi M1,

                          Just an update on my current position. Once again thanks for all the help from everyone, Especially you M1, It is greatly appreciated.

                          I sent a reply with the above draft you had wrote out for me and also added me in my own details regarding the DPA Section B2 etc and have just received what looks like a positive reply from WH appearing as if they might back off now?
                          I will attach it, If you could take a look and let me know your thoughts it would be greatly appreciated as well.
