    Hi, my name is carol and I am stunned at a parking notice i received yesterday. Every year we go to cornwall for my holidays, we use to go for a week in june and a week in september. We now go for a month, the whole of June. As you can imagine we use the car park's there a hell of a lot and pay between £100 and £150 in car park fee's through out the month. we have even put money in the pay and display's that don't work but keep's yoour money. We don't mind paying as that is what they are there for. We save all year round my pound coin's just to leave in the car for car parks as we have been penalised before today whilst going for change for the meter. Anyway, we have always parked in Newqauy tower road trinity church when it was run by attendance which was £5 all day and the other year parking eye was in place there. You had to type in your reg number and on one occasion we must of misjudged the digits or the driver's fingers were to fat and when we got home I was welcomed by a letter to pay up. I rang them and told them we had paid and had my ticket and noticed we had entered a wrong digit. The man I spoke to checked on their records and he also noticed our mistake and told me that was the end of the matter and it was. However, this year we decided to hire a car as ours is getting old and we hired it from rentacars.com. The company we got it from was green motion based at manchester airport and they also take a credit card to pay for deposit. We had also taken out full protection insurance of £120 and £20 of fuel. We arrived home on 1st July took car back no problems. The other day I went online to see how much we owe on our credit card and noticed £85 taken out by green motion on the 19th July. I was totally baffled as this is 3 weeks after handing the car back and I couldnt understand what this was....till yesterday that is. I received a parking notice off parking eye saying we had not paid, also i need to pay £100 or £60 if i pay in 14 day's and that they got my details from dvla. I have looked online and am amazed at how many people this has happened to also. Now last time I rang and it was dealt with over the telephone but now you cannot ring you have to write or email. By looking at it a few year's down the line there is little chance of me getting my £85 back that they so kindley helped themselves to and demand another £100. After looking things up they are entitled to take that money from the hire company and they help themselves to mine, Any one else they can't do this it's just because its a hired car. It would of been nice to at least be informed. I am baffled now as to what to do, I have filled the form in on parking eye for the complaint and explained that the driver must of typed a wrong digit in or done somthing wrong of the machine or maybe the machine is wrong, i don't know but one thing i do know is that day was raining heavy and we also paid and displayed. We also paid for 3 hrs but was only there an hour and half then left. Could any one please advise me on what to do if parking eye turn me down on this. I know they can check their system as the first year they set up there the gentleman i spoke to that dealt with it checked it on their system and found the mistake I did and canceld the parking notice. As the year's gone by and looking at other's that have wrote about this they are getting turned down. This is shocking and bad and to think how much I spend in these car park's in one year is scanless. To another company I would be classed as a valued customer and they would correct my mistake but this is a bit much. I can't afford that in a million year's so please what should I do if they wont rectify this error?

    What have the rental company charged you for? £85 seems rather high. What is the EXACT wording on the agreement ? You could reclaim it by raising a dispute with the card company. They could be entitled to do this for penalties and fines but PE can neither raise penalties not fines, only invoices.

    Don't phone PE. They have sent you a PCN because the rental company have given your name and address and you are the keeper. DO NOT CONTACT PE BY PHONE. With the Notice from PE when did you get it and did it contain a copy of your rental agreement ? If the documents are missing then you, as the keeper, will tell them that they have failed to follow the law and you, as the keeper at the time, can not be held liable.

    Post up the letter you received from PE, deleting your personal details and PCN number.

      I booked online with rentalcars.com and it was car hire green motion i collected my car. I have just found my agreement with green motion and here is the wording. exactly.
      Speeding Fines, Parking Fines,Bus Lanes -if you incur any speeding fines, parking fines,or other road traffic offences that are notified to us then an administration fee of £84.00 will be charged plus any cost we incur.

        PE DATE OF EVENT 28/06/2016 issued date 04/08/2016 PARKING CHARGE AMOUNT DUE: £100.00 Payment to be made within 28 days of date issued: 01/09/2016This parking charge is discounted to £60.00 if paid within 14 days of the date issued 18/08/2016 After this, the full parking amount will be owed

              Please help, I don't know what to do. cAN'T BELIEVE ALL THIS AND WE HAVE PAID THE CAR PARK, WE ALWAYS HAVE, tHEY SHOULD KNOW THIS ON THIER SYSTEM.

                What you received from PE was none of the above, only an invoice. Straight on to your credit card company and tell them that charge was unauthorised and you want the money back.

                A Parking Charge is not an offence, nor a parking fine nor a RTA offence

                  It is imperative that the identity driver is not inferred. Go through all your posts so far and edit them to say "the driver did this ...." the driver did that ...." etc.

                  Your attachments are fine, you should be able to see them yourself. But take down the PCN picture and repost with identifying details removed. Car reg no, Ref No etc. Leave the dates. If they don't know the driver they can claim from the keeper but only if they comply completely with the requirements of POFA.

                  I'm going to check if the NTK was delivered to you in the correct time. What date did you actually receive the letter ? Did it also contain a copy of your rental agreement?

                  Edit: Unfortunately they got it to you in time.

                    i received this notice off PE yesterday, 13th august, on its own, the rental agreement i have from when i hired the car, it was green motion the rental place that helped themselves to £84. I didnt even get notified and I still havnt. They don't know I know yet, I only noticed on thursday when i went online to check my statemnts. and it was 21st Just Green Motion withdrawn £84. I was going to pop to the car hire place next week to ask them do they know what it is but yesterday when I also got PE notice in the post that I started to put two and two to-gether. I then read some of the car hire contract like you asked me to when it states on the waver that they charge admin fees of £84 for handing my details over to PE and also add any more cost if possible. They have my card details from using it for my £400 deposit and they have just took it without even informing me. I am so shocked that anyone can do this. does this mean they can take whatever they want in the future? Also, i dont use credit cards normally and this one was 0% but due to Green Motion self service to this does that mean as it is cash I loose my 0% and also no incur interest?

                      i realy did pay the car park for 3 hrs, also displayed in my window, the ticket would of been still in the hired car. This is realy bothering me, I can't describe how shocked I am. If they want proof I paid they cant check their system like they did the other year and agreed with me. I might not of even made an error typing my plate. They can proove if I paid if they realy wanted to but they want eveidance off me. What should I do? I feel like the clock is ticking and am going to incur more charges. So sorry if I sound off I am just so worried on how to pay all this. I should of gone in my old car and maybe this wouldnt of happend. Please forgive me.

                          When there is a car hire involved the parking companies are required to include a copy of the relevant portions of the rental agreement with their Notice to Hirer. The letter from PE is a Notice to Hirer. This needs to comply with the requirements of POFA 2012 to hold you, the keeper at the time, liable for the parking charge. One of the requirements is that you should receive a copy of the hire agreement with the NTH. Did you receive a copy of that hire agreement ?

                          For the £85 that the rental company took the rental agreement does not give them the right to charge you £85 in this instance (the parking charge is not a fine or offence) so just get on to your credit card company and say that the amount was taken without your agreement and you want it back.

                            Did you get sent any of these with the parking eye pcn ?

                            (2)The creditor may not exercise the right under paragraph 4 to recover from the keeper any unpaid parking charges specified in the notice to keeper if, within the period of 28 days beginning with the day after that on which that notice was given, the creditor is given—


                            (a)a statement signed by or on behalf of the vehicle-hire firm to the effect that at the material time the vehicle was hired to a named person under a hire agreement;


                            (b)a copy of the hire agreement; and


                            (c)a copy of a statement of liability signed by the hirer under that hire agreement.


                            If not then the keeper has no liability and so if they do not know the drivers identity they'll lose.



                            I would also email Green Motion and point out that this is not a speeding fine, parking fine, or other road traffic offence.

                            The BPA code of practice to which Parking Eye subscribe specifically does not allow this.

                            14.2 You must not use terms which imply that parking is
                            being managed, controlled and enforced under statutory
                            authority. This includes using terms such as ‘fine’, ‘penalty’
                            or ‘penalty charge notice’.


                            They have no right under the contract with you, that you've shown, to charge £84 for a speculative invoice.
