    Hello LegalBeagles!

    Resurrected this thread because I'm having a headache with premier park.

    Someone parked in a pub car park for lunch (at the same pub), left an hour later and thought nothing more of it. A few weeks later I got a very official looking fine through with photos of the car and timestamps I appealed through their online form attaching a proof of purchase. They've just rejected that and have said that I can pay £60 now or £100 after the 3rd of August. They've also said that any further attempt to communicate will be ignored which sounds fishy.


    Note: The pub don't want annything to do with it.

    Thanks for any advice you guys might have!

      Alas I'm on holiday till the 9th. And they'll demand more money on the 3rd. So I suppose I was just asking if you can argue that since nobody told me to register my car and I have a reciept for the meal. The fine is unjustified?

        Go back through all your posts and edit to remove the inference of who was actually driving. You started well and then it all fell apart.

        Is the pub part of a chain?

          You'd lose on that.

          You can argue the usual popla stuff after an initial appeal fails and that has a decent chance to win. If we can still argue keeper liability successfully applies then the usually concede at popla.

          If you try popla, and no guarantees of a win but good chances, then any discount is lost.

            Okay after a brief temptation to throw money at it to make it go away I've decided to **** them and go for a popla appeal. Any advice you have on how I can argue this Would be much appreciated.

            1. Unclear signage.
            The driver has one witness who was with them during the whole stay at the pub. Who is willing to verify that the signs claiming the driver had entered a contract were not visible to either the driver nor her. Nor at any point during visit to the pub did the bar staff ask if they had registered the car. Therefore I argue that it is unreasonable to claim that they knowingly entered into a contract with premier park.

            2. The driver was a genuine customer.
            I'm sure hsbc will be happy to verify that on the date on question a payment of £23.81 was paid to the *insert pub name* at approximately 2pm (when the parking charge was issued). Therefore the charge is entirely unreasonable as the driver was a genuine customer of *insert pub name*.

            3. Refusal to engage in conversation.
            I received an email after my failed appeal saying "all further attempts to contact premier park will be ignored". Surely if this is a contract as they say it is, a dispute can only be resolved either if both parties agree or if a judge makes a decision? So surely refusal to maintain dialogue weakens their case.

            Obviously I'll work on the grammar and layout but I think that along with a witness statement and a bank statement should be good enough?

                Thanks for that link, the popla code was generated one day before my rejection email so they said consider making a complaint. And the deadline is the 17th for popla.

                Unfortunately I too am out of the country till he 10th so may not have access to a computer and certainly not the documents. Given these circumstances might it be simpler to pay the discounted charge and leave the pub a scathing trip advisor review?

                  It's always simpler to pay but way more painful.

                  7 days is plenty time to sort an appeal but the call is yours.
