I too have fallen fowl of McDonalds at Gatwick. I have been sent a picture of me entering the McDonalds Car Park and exiting 1 hour and 11 minutes later, however I only actually parked in the bays for 56 minutes as I was absolutely watching my time. I did go into McDonalds and bought and ate a vegetarian breakfast and I have the receipt on my debit card. When I parked my vehicle it was absolutely full and I kept driving around the car park for, it would appear 15 minutes, but was actually only parked for 56 minutes, which is under the 60 minutes allowed.

It says on the ticket that if I send £50 now the ticket will be cleared or I have to pay £100. There are two dates of issue - one is 20/07/16 and the other is 17/08/16. I only actually received this on Saturday - 23/07. They are saying that 14 days of the date issued is 3/8/16.

This is not fair, as I have MS, I really try hard not to get into stressful situations and this is definitely stressful.

All help would be gratefully received.

The times they measure are the times between entering the car park and leaving, ie not the time you parked. They have to allow you time from entry to find a parking space and when you are leaving they have to give a grace period of at least 10 minutes. So those should cover the times.

You mention MS. Do you have readily available documentation to verify this, such as a blue badge? As this would be classed as a disability then they have to make extra allowances under the Equailitys Act (?) to accommodate this and make an extra allowance. Not to make allowance for disabilities is a criminal offence which McD would also be liable.

Is it possible to visit McD again and complain to the manager and point out that you are disabled and he and the PPC are liable in law for failure to make allowances and therefore the PCN should be cancelled.

I don't have a blue badge as I am physically and luckily OK at the moment, but things do take me longer. I do have lots to prove that I have this condition. I didn't think I would put it in the letter as I didn't want them to know who was driving.

The signs will say "parking limited to 60 minutes" but the cameras do not know what time you parked and left the parking slot.

Speaking as a former in-house McDonald's lawyer (some years ago) ...

As well as following the procedure set out in the notice -be rational, reasonable and not than Mr Angry- go on line and look into their UK website and see if you can speak to their complaints department. Ask them to take it up. The restaurant may be franchised rather than company-owned, so not within the complaints department direct control, but they should be able to influence the franchisee.

I would hope they would treat it as a public relations issue rather than a legal/parking issue.

It may be more complicated if it is an outsourced company running the parking system though.

Thank you. I tried to call McDonalds, but had absolutely no help from them, but I think I was only talking to a very junior reception person, they have rejected my letter and told me I have to pay, so POPLA her I come...
