      Excuse my ignorance but from what I am reading the Baiilff has clamped a car not belonging to the named debtor on the paperwork and despite proof that all semi intelligent people would believe has done this with the Council aiding and abetting which must be a crime if this is allowed they will be able to clamp any car the wish and even if absolute proof is given get away wit ii

        She said she moved and did not get the letters under advice from the Council (when she phoned them worried about a bailiff calling at her previous address).

        We've gone through all the paper work and there isn't a reason why the forms were refused. It just says 'Swansea is not willing to accept the late statement'.

        It goes to say to that the Council have sent all letters plus the TE3 and TE9 to the address they held and there was no correspondence and because it was the address they had on their system, they were not at fault.

          Just a quick question...been digging around the weekend.

          The warrant is allocated for address A (has not been changed).
          The enforcement took place at address B
          Bailiff filled in Notice After Entry & Removal Notice with address B on both

          Car was clamped near address B
          Car registered at address A & keeper/owner is not named on warrant (not the debtor)

          A and B are 40 miles away from each other.

          I'm guessing the enforcement is unlawful.
          Am I correct and what can I do now?

            I would still stick to what I said previously, complain to the Ombudsman as a starting point, see what they say and if you are still not happy then your next course of action will be the courts.

            Just to clarify the name on the warrant is not your name it is your daughters? Either way to me, if the bailiff has clamped your car which they had no right to do then you have a right to redress.
