PCN - Excel Parking - Stirling (Scotland)

I wonder if you could help. I've seen conflicting advice on different forums and having spoken to Citizens Advice today I think I'm on a losing battle.

I park in the Rainbow Slides Car Park in Stirling frequently and have always paid my ticket. There have been several occasions where the machines have either refused money or not issued me a ticket. So when i didn't get a ticket on this occasion I wasn't concerned. However I was issued a PCN.I replied advising i would not be paying the fine and asked that they check their machines as I was not alone in having this problem on that day. (customers behind me in the queue).

They refused my response and advised I appeal. Not fully understanding the do's and donts I didn't appeal, because I felt I had nothing to appeal about, they have my money and they were in the wrong.

However today I've received a letter now threatening Court/Debt Collectors.

I've read a previous posting on here about keeper liability in Scotland, however wonder if anyone could advise on where I stand?

Oh and another point, they have spelt my name wrong on the PCN, does that help my case?

There is no Keeper liability in Scotland, only the driver. If they know the name of the driver they can take action against the driver.

Edit your first post so that who was driving can't be inferred but it may be too late.

Court cases are rare in Scotland as they require the driver to be known. For 1 ticket they probably wouldn't go to too much trouble. For a few they may scour cctv etc but that still doesn't give the drivers name. Having said that, if they have pics you'd need to use a lawyer so they couldn't ID the driver from the pics.
