Hi, i wondered if any one could offer some advice.
Back in July I parked in a private car park in Nottingham. When I went to pay for a ticket the machine was 'out of use'. ( I took photographs to prove this) This was the one and only machine in the carpark.
I left a note in the car window to explain that the machine wasn't working and went off to my meeting. When I returned to the car park i saw that the machine was back in use so purchased a ticket to cover the cost of my stay. Upon returning to the actual car I found that I already had a ticket (form parking eye)
I presumed that as the machine was out of use when i originally parked, that they would discard the parking ticket. Unfortunately i was mistaken. I then appealed and enclosed all photographic evidence but it was rejected as apparently, if i couldn't display a valid ticket i shouldn't park there!
I am now receiving letters from Rossendales collect threatening recovery action.
Should i just cut my losses and pay the now £130 fine or keep arguing it?
Because i then purchased a ticket once the machine was back in use, they didnt experience any loss of revenue so am amazed that they are persuing this claim.
