  • Civil enforcement fine- no longer owner of the vehicle

    can anyone help, I received a parking fine from Civil Enforcement for a vehicle i used to own. The date of the fine was after i sold the vehicle. I appealed to Civil Enforcement telling them I was no longer the registered keeper of the vehicle and wasn't on the date of the parking fine and that they need to contact the new registered keeper.

    They have rejected my appeal telling me I need to provide proof I am no longer the registered keeper. I threw away the slip from the DVLA confirming this and I have no sale invoice at all.

    Can anyone advise where i need to go from here?

    Phone the dvla and confirm they have noted the change on their computer.

      I would get the proof you were not the Owner/keeper at the time and keep it when they take you to court you have an absolute defence then you can claim expenses of them

        Write to DVLA requesting a letter confirming the date of sale or transfer of your vehicle, if they don't reply within 3 weeks, write a letter of complaint to the DVLA CEO, because that is what I had to do. Keep original then send copy to Civil Enforcement along with a claim for 'out of pocket costs' you've incurred.

            Thanks for voting me as best advice, further down the line now in this extraordinary scenario, Solicitors could not help, Citizen's Advice could not help, my MP was reticent to help, though did advise coming to him at the very earliest stage should it happen again, (how did I know I should do that) at that time!.....

            Moving on, after going through the Council's complaints procedure (all a waste of time), and then speaking directly to the court staff, I managed to persuade (on advice from the court) that my court case should be dropped and was dropped eventually 13 months from the start!,.......

            I have now completed step 1 and step 2 complaints procedure at DVLA (to no avail) and it now lies with the Parlimentary and Health dept, (a kind of ministry ombudsman service) who have yet to reply, well I've got all the time in the world for my compensation claim against the bungling DVLA.....Watch this space.
