  • Failed POPLA Appeal

    Hi Guys,

    I received a parking charge notice a while back.

    Basically in a Nutshell, at the block of flats I live in I could not park in my allocated space as someone was parked poorly. No visitor spaces available, so I had to put it in the most appropriate place (which people regularly do) This was about 7pm, returned to the car at 9pm to try and move it and I had a PCN! Appealed through POPLA and they refused the appeal.

    I'm not denying I was parked where I knew I shouldn't have been, but I had little choice, our block of flats is off a main road which you could never even consider parking on, so not sure what I was expected to do.. drive around all night until a space appeared.. and also how 100 quid is an appropriate fine I'll never know!

    I'm quite happy to ignore all their letters and let them take me to court if need be. Does anyone know the likelihood of court?

    Depends on which company and also what happens with Beavis.

    Did you cite genuine pre estimate of loss to popla or just explain the parking situation ?

      Who owns the land where you parked?
      What contractual arrangement does the parking company have with the land owner?
      As mystery1 says, there is no genuine pre-estimate of loss and GPEOL is the normal complete winner at POPLA.
      With no disrespect to this excellent Forum, can I suggest you look at Pepipoo's Fightback Forum?

        I mentioned the excessive fee, but not pre-estimate of loss.

        Unfortunately I sent off the appeal before doing enough research on what to include.

        Is this something I can bring up in court, if it goes that far?

          Wouldn't do you any good. Sit tight for now barring a letter before claim or actual claim.

            As mystery1 says, wait and see now but, be warned.
            Some of the patking companies might issue CC proceedings without a LBA.
            Parking Eye often does this.
            If you get a letter from County Court Business Centre at Northampton, come straight back here.
            Watch what happens with the Barry Beavis result, due in 10 days or so.
